Seller’s Right to Make Changes to Project Documents. Seller reserves the right to amend or vote to amend, as applicable, the Project Documents at any time or from time to time prior to the Closing as Seller may deem necessary or desirable to make corrections or to meet the requirements of applicable laws, governmental regulations, lending institutions, marketing programs and to make other changes or so long as the amendments do not materially diminish the practical enjoyment and use by Purchaser of the Unit. Purchaser acknowledges that Seller has reserved the right, at any time after Closing, to amend the Project Documents for the purposes and under the conditions outlined in the Project Documents and permissible under Colorado law. Prior to Closing, if such amendment, modification, change or revision materially adversely affects the rights of the Purchaser, Purchaser may terminate this Agreement within ten (10) days after receiving a copy of such amended, modified, changed or revised documents or materials, whereupon the Xxxxxxx Money Deposit paid by Purchaser shall be refunded by Seller and the parties hereto shall have no rights or liabilities hereunder. In the event Purchaser fails to provide Seller with such notice of termination within said three (3) day period, Purchaser shall be conclusively deemed to have consented to the amended, modified, changed or revised documents or materials, and this Agreement shall remain in full force and effect.
