Common use of Seller’s Rights Clause in Contracts

Seller’s Rights. The Seller will have the right to have any Warranted Part, or any part removed therefrom, which is claimed to be defective, returned to the Seller, as set forth in Subclause 12.1.6(i), if, in the judgment of the Seller, the nature of the defect requires technical investigation. Subject to applicable safety rules and the Buyer's contractual obligations with labor unions, the Seller will further have the right to have a representative present as an observer during the disassembly, inspection and testing of any Warranted Part claimed to be defective. Such representatives will not unreasonably interfere with the Buyer's operation and personnel.

Seller’s Rights. The Seller will have the right to have require the delivery to it of any Warranted Part, or any part removed therefrom, which therefrom that is claimed to be defective, returned to the Seller, as set forth in Subclause 12.1.6(i), if, in the judgment of the Seller’s judgment, the nature of the claimed defect requires technical investigation. Such delivery will be subject to the provisions of Clause 12.1.7(ii). Subject to applicable safety rules and the Buyer's contractual obligations with labor unionsrules, the Seller will further have the right to have a representative present as an observer during the disassembly, inspection and testing of any Warranted Part claimed to be defective. Such representatives will not unreasonably interfere with the Buyer's ’s operation and personnel.
