Common use of Server Backup and Recovery Clause in Contracts

Server Backup and Recovery. The following “Backup and Recovery” Resource Unit Categories shall fully compensate Service Provider for the performance of Server Backup and Recovery Services including the required infrastructure costs and management of intermediate storage. For clarity, backup and recovery infrastructure, support costs for such infrastructure and related volumes cannot be included in any other Resource Unit Category. All data backed up is billable only once, regardless of the number of intermediate copies produced as a result of the backup process. System overhead and operating system sizing will be included in the annual Deliverable and discussed as part of governance. At a minimum, the exclusions will include:  Hardware Management Console Storage – Internal capacity used for backup operation  Multiple copies of backup data – Copy pools and secondary copies used by the Service Provider, but not requested by the Customer  Intermediate backup data – Media server storage in non-Avamar environments
