Anti-Trust Sample Clauses

Anti-Trust. The MA Dual SNP hereby certifies to HHSC that neither the MA Dual SNP, nor the person represented by the MA Dual SNP, nor any person acting for the represented person, has been found by a judgment of a court of law to have violated the anti-trust laws codified by Chapter 15, Texas Business and Commerce Code, or the federal anti-trust laws.
Anti-Trust. Seattle maintains that, in actual practice, overcharges resulting from antitrust violations are borne by the purchaser. Therefore the Contractor hereby assigns to Seattle any and all claims for such overcharges except overcharges which result from antitrust violations commencing after the price is established under this contract and which are not passed on to Seattle under an escalation clause.
Anti-Trust. Contractor hereby irrevocably assigns to the State of Connecticut all rights, title and interest in and to all Claims associated with this Contract that Contractor now has or may or will have and that arise under the antitrust laws of the United States, 15 USC Section 1, et seq. and the antitrust laws of the State of Connecticut, Connecticut General Statute § 35-24, et seq., including but not limited to any and all Claims for overcharges. This assignment shall become valid and effective immediately upon the accrual of a Claim without any further action or acknowledgment by the parties.
Anti-Trust. In accepting the Contract, the Contractor certifies and agrees as follows: 1. Neither the Contractor, nor the person represented by the Contractor, nor any person acting for the represented person has: i. violated the antitrust laws codified by Chapter 15, Business and Commerce Code, or the federal antitrust laws; or ii. directly or indirectly communicated the bid or offer associated with this Contract to a competitor or other person engaged in the same line of business. 2. The Contractor hereby assigns to DARS any and all claims for overcharges associated with this Contract arising from the Contractor’s violation of the anti- trust laws of the United States, 15 U.S.C.A. Section 1, et seq. (1973), as amended, and the anti-trust laws of the State of Texas, Texas Business and Commerce Code, Section 15.01, et seq. (1967), as amended.
Anti-Trust. The MA Health Plan hereby certifies to HHSC that neither the MA Health Plan, nor the person represented by the MA Health Plan, nor any person acting for the represented person, has been found by a judgment of a court of law to have violated the anti-trust laws codified by Chapter 15, Texas Business and Commerce Code, or the federal anti-trust laws.
Anti-Trust. The Parties recognize that, in actual economic practice, overcharges resulting from antitrust violations are usually borne by the State and the Subscribing Entities. The Service Provider therefore assigns to the State all state and federal antitrust claims and causes of action that the Service Provider now has or may acquire relating to the Services that are covered by this Agreement.

(2) CONTRACTOR hereby assigns to HHSC any and all claims for overcharges associated with this contract arising under the anti-trust laws of the United States, 15 U.S.C.A. Section 1, et seq. (1973), as amended, and the anti-trust laws of the State of Texas, TEX. BUS. & COMM. CODE XXX. Section 15.01, et seq. (1967), as amended.
Anti-Trust. In submitting a proposal, and in accepting the Contract or purchase order, Contractor certifies and agrees as follows: (1) Neither the CONTRACTOR, nor the person represented by the CONTRACTOR, nor any person acting for the represented person has: (a) violated the antitrust laws codified by Chapter 15, Business & Commerce Code, or the federal antitrust laws; or (b) directly or indirectly communicated the bid/offer associated with this contract to a competitor or other person engaged in the same line of business. (2) CONTRACTOR assigns to HHSC all of CONTRACTOR’s rights, title, and interest in and to all claims and causes of action CONTRACTOR may have under the antitrust laws of Texas or the United States for overcharges associated with this contract.
