Service Credits under Third Party Contracts. In the event that Provider is entitled to receive a credit for service under a Third Party Contract which has been assigned from Company to Provider, Provider shall pass such credit through to Company; provided, however, that where an event that results in Provider's failure to meet a KPI also results in Provider being eligible to receive a credit from a Third Party Vendor under a Third Party Contract which has been assigned from Company to Provider, Company must elect to receive as a credit from Provider either the amount of the credit due from the Third Party Vendor, or the Service Credit from Provider.
