Common use of Servicer Obligations Clause in Contracts

Servicer Obligations. (i) Xxxxx Fargo Bank shall have no obligation to provide investment directions pursuant to Section 2.11 or any other Section requiring investment directions from the Servicer. (ii) Xxxxx Fargo Bank shall not be responsible for any deficiency collections or enforcement of the Borrower’s rights under the Second Tier Purchase Agreement, as set forth in Section 7.03(c)(i). The Administrative Agent hereby agrees to enforce the rights of the Borrower under the Second Tier Purchase Agreement.

Servicer Obligations. (i) Xxxxx Fargo Bank Bank, in any of its capacities hereunder, shall have no obligation to provide investment directions pursuant to Section 2.11 2.10 or any other Section requiring investment directions from the Servicer. (ii) Xxxxx Fargo Bank Bank, in any of its capacities hereunder, shall not be responsible for any deficiency collections or enforcement of the Borrower’s rights under the First Tier Purchase Agreement or the Second Tier Purchase Agreement, as set forth in Section 7.03(c)(i). The Administrative Agent hereby xxxxxx agrees to enforce the rights of the Borrower under the Second Tier Purchase Agreement.

The Administrative Agent hereby agrees to enforce the rights of the Borrower under the Second Tier Purchase Agreement.
