Common use of Settled Defendants means Clause in Contracts

Settled Defendants means. (a) Hitachi, Ltd., Hitachi Automotive Systems, Ltd. and Hitachi Automotive Systems Americas, Inc.; and (b) any Defendant that has entered into a settlement agreement with the Plaintiffs in the Proceedings and whose settlement agreement becomes effective in accordance with its terms, whether or not such settlement agreement is in existence at the Date of Execution.

Settled Defendants means. (a) Hitachi, Ltd., Hitachi Automotive Systems, Ltd. and Hitachi Automotive Systems Americas, Inc.; and (b) any Defendant that has entered into a settlement agreement with the Plaintiffs in the Proceedings or the Second Ontario Action and whose settlement agreement becomes effective in accordance with its terms, whether or not such settlement agreement is in existence at the Date of Execution.
