Common use of Site Condition Clause in Contracts

Site Condition. Buyer warrants that the site where Goods are to be delivered and/or installed and/or where Services are to be performed shall be ready and adequate for Seller’s delivery and/or installation of the Goods and/or performance of Services. Buyer’s obligations in this regard include but are not limited to the removal of all obstructions and institution of adequate safety measures to protect Seller’s property, employees, agents and contractors. Buyer shall be responsible for all costs and expenses associated with Seller’s delay and/or inability to deliver and/or install the Goods or perform any Services related to Buyer’s failure to comply with this Section 7.f. Seller in no way warrants the sufficiency of the site, in whole or in part, where the Services are performed and/or Goods are to be delivered, installed and/or used.
