SMALL BUSINESS INCLUSION Clause Samples

The Small Business Inclusion clause is designed to promote the participation of small businesses in a contract or procurement process. Typically, it requires the contracting party to make efforts to include small businesses as subcontractors or suppliers, or to meet certain targets for small business involvement. For example, a contractor may need to report on their use of small business vendors or demonstrate outreach to small business enterprises. This clause helps ensure that small businesses have fair opportunities to compete and benefit from larger contracts, fostering diversity and supporting economic growth within the small business sector.
SMALL BUSINESS INCLUSION. Upon Request by Enterprise Services, Contractor shall provide, within thirty (30) days, an Affidavit of Amounts Paid. Such Affidavit of Amounts Paid either shall state, if applicable, that Contractor still maintains its MWBE certification or state that its subcontractor(s) still maintain(s) its/their MWBE certification(s) and specify the amounts paid to each certified MWBE subcontractor under this Master Contract. Contractor shall maintain records supporting the Affidavit of Amounts Paid in accordance with this Master Contract’s records retention requirements.

Enterprise Services is committed to providing the maximum practicable opportunity for small and diverse businesses to participate in state contracting opportunities. Diverse businesses are defined in WEBS as follows: small business, microbusiness, mini business, Washington State Office of Minority and Women’s Business Enterprises (OMWBE) certified minority owned (MBE) or women owned business (WBE), or Washington Department of Veterans Affairs (DVA) certificated veteran owned business. Upon request, Contractor shall report to Enterprise Services it’s spend with certified diverse businesses. Such reports shall include the period covered and sales amount by Purchasing Entity to such businesses.
