Software Media. You may receive the SOFTWARE from the Internet, on-line network connection, or in disk media or on a CD-ROM or installed on the hard disk drive or ROM of your computer, or in multiple forms of media. Regardless of the number or type(s) of media you receive, you may use only the media appropriate for your single computer. You may not use the other media on another computer or loan, rent, lease, or transfer them to another user for any purpose whatsoever.
Software Media. Famic warrants that, for a period of thirty (30) days from the date of shipment from Famic, as evidenced by the date of the original invoice for the Software, the Physical Memory Media (if any) on which the Software and Documentation are recorded as well as the Protection Key are free from defects in material and workmanship under normal use and service. Famic’s entire liability and Licensee’s exclusive remedy as to the Physical Memory Media and the Protection Key shall be, at Famic’s sole and exclusive option, either:

NETWORK CHANGE COORDINATION Significant Changes to Client’s Network You will notify us via email of all significant proposed network changes and will provide us with a reasonable opportunity to comment and follow-up regarding those proposed changes. Research Regarding Network Changes Evaluation of network change requests sometimes will require significant research, design, and testing by Provider. These types of requests are not covered by this Service Attachment and will be billed at our then-current rates for time and materials. SUITABILITY OF EXISTING ENVIRONMENT

Security and Regulatory Recommendations Although it is under no obligation to do so, from time to time, Provider may make recommendations regarding regulatory compliance, safety and security related to Client’s network and practices (e.g., multi-factored authentication). If Client fails to adopt or implement the recommended protocols, Client is responsible for any and all damages related to regulatory, security, privacy, or data protection, including but not limited to fines, data breach notification, malware or ransomware costs, restoration, forensic investigation, restoring backups, or any other costs or damages related to Client’s refusal to implement the recommended protocols.
Software Media. Alepo warrants any magnetic media on which the Licensed Program is recorded and the Documentation to be free from defects in tangible materials and accuracy of reproduction from the master media. Xxxxx will replace at no charge defective original media or Documentation returned to it with proof of payment.
Software Media. All Map and/or Chart software delivered under this Agreement are subject to the license terms set out below. All software license terms are established directly between the Customer (Licensee) and FishTec, the rightful creator, owner and licensor of the map and/or chart media/software.

During the time that the Agreement is in effect, in the case of upgrades, Novell will ship to Customer 1 set of software media along with the license diskettes for the upgrade after it becomes commercially available. The software media may contain a serial number that has been registered by Novell to Customer.

Licensor will replace at no charge defective original media or Documentation returned to it with proof of payment.

TERM AND TERMINATION Term This Service Attachment is effective on the Service Start Date identified in the Order. Unless properly terminated by either party, this Service Attachment will remain in effect through the end of the term specified on the Order (the "Initial Term"). Renewal "RENEWAL" MEANS THE EXTENSION OF ANY INITIAL TERM SPECIFIED ON A ORDER FOR AN ADDITIONAL TWELVE (12) MONTH PERIOD FOLLOWING THE EXPIRATION OF THE INITIAL TERM, OR IN THE CASE OF A SUBSEQUENT RENEWAL, A RENEWAL TERM. THIS SERVICE ATTACHMENT WILL RENEW AUTOMATICALLY UPON THE EXPIRATION OF THE INITIAL TERM OR A RENEWAL TERM UNLESS ONE PARTY PROVIDES WRITTEN NOTICE TO THE OTHER PARTY OF ITS INTENT TO TERMINATE AT LEAST SIXTY (60) DAYS PRIOR TO THE EXPIRATION OF THE INITIAL TERM OR OF THE THEN-CURRENT RENEWAL TERM. CLIENT MAY CANCEL AN AUTOMATIC RENEWAL BY CONTACTING PROVIDER AT (000) 000-0000. Month-to-Month Services If the Order specifies no Initial Term with respect to any or all Services, then we will deliver those Services on a month-to-month basis. We will continue to do so until one party provides written notice to the other party of its intent to terminate those Services, in which case we will cease delivering those Services at the end of the calendar month in which such written notice is received by the other party.
