Sovereign and Governmental Immunity. Acting under authority of the Texas Government Code Section 1371.059(c), as amended, the City agrees to waive sovereign and governmental immunity from suit and liability for purposes of adjudicating a claim to enforce this Agreement and/or the Fee Agreement or for damages for breach of this Agreement and/or the Fee Agreement.

Sovereign and Governmental Immunity. THIS AGREEMENT IS MADE SUBJECT TO THE CITY’S GOVERNMENTAL AND SOVEREIGN IMMUNITY, INCLUDING WITHOUT LIMITATION, TEXAS CIVIL PRACTICES AND REMEDIES CODE, TITLE 5 AND ALL APPLICABLE FEDERAL AND STATE LAWS. THE PARTIES EXPRESSLY AGREE THAT NO PROVISION OF THIS AGREEMENT IS IN ANY WAY INTENDED TO CONSTITUTE A WAIVER OF ANY IMMUNITIES FROM SUIT OR FROM LIABILITY, OR A WAIVER OF ANY TORT LIMITATION, THAT THE CITY HAS BY OPERATION OF LAW, OR OTHERWISE.
Sovereign and Governmental Immunity. Notwithstanding any other term or provision in the Agreement, nothing herein is intended nor shall be interpreted as waiving any claim or defense based on the principle of sovereign immunity, governmental immunity, or other State or federal constitutional provision or principle that otherwise would be available to the City or UNC under applicable Laws and Regulations.

  • Governmental Immunity The Town and its officers, attorneys and employees, are relying on, and do not waive or intend to waive by any provision of this Agreement, the monetary limitations or any other rights, immunities or protections provided by the Colorado Governmental Immunity Act, C.R.S. § 00-00-000, et seq., as amended, or otherwise available to the Town and its officers, attorneys or employees.

  • No Waiver of Governmental Immunity Nothing in this Agreement shall be construed to waive, limit, or otherwise modify any governmental immunity that may be available by law to the Town, its officials, employees, contractors, or agents, or any other person acting on behalf of the Town and, in particular, governmental immunity afforded or available pursuant to the Colorado Governmental Immunity Act, Title 24, Article 10 of the Colorado Revised Statutes.

  • Sovereign Immunity The State reserves all immunities, defenses, rights or actions arising out of the State’s sovereign status or under the Eleventh Amendment to the United States Constitution. No waiver of the State’s immunities, defenses, rights or actions shall be implied or otherwise deemed to exist by reason of the State’s entry into this Agreement.
