Common use of Space Allocation Clause in Contracts

Space Allocation. BellSouth shall assign PTLLC Collocation Space that utilizes existing infrastructure (e.g., HVAC, lighting and available power), if such space is available for collocation. Otherwise, BellSouth shall attempt to accommodate PTLLC's requested space preferences, if any, including the provision of contiguous space for any subsequent request for collocation. In allocating Collocation Space, BellSouth shall not materially increase PTLLC's cost or materially delay PTLLC's occupation and use of the Collocation Space, assign Collocation Space that will impair the quality of service or otherwise limit the service PTLLC wishes to offer, reduce Version 2Q04: 08/18/04 unreasonably the total space available for physical collocation or preclude unreasonable physical collocation within the BellSouth Premises. Space shall not be available for collocation if it is: (a) physically occupied by non-obsolete equipment; (b) assigned to another collocated telecommunications carrier; (c) used to provide physical access to occupied space; (d) used to enable technicians to work on equipment located within occupied space; (e) properly reserved for future use, either by BellSouth or another collocated telecommunications carrier; or (f) essential for the administration and proper functioning of the BellSouth Premises. BellSouth may segregate Collocation Space and require separate entrances for collocated telecommunications carriers to access their Collocation Space, pursuant to FCC Rules.

BellSouth shall assign PTLLC Neutral Tandem Collocation Space that utilizes existing infrastructure (e.g., heating, ventilation, air conditioning (HVAC), lighting and available power), if such space is available for collocation. Otherwise, BellSouth shall attempt to accommodate PTLLC's Neutral Tandem’s requested space preferences, if any, including the provision of contiguous space for any subsequent request for collocation. In allocating Collocation Space, BellSouth shall not materially increase PTLLC's Neutral Tandem’s cost or materially delay PTLLC's Neutral Tandem’s occupation and use of the Collocation Space, assign Collocation Space that will impair the quality of service or otherwise limit the service PTLLC Neutral Tandem wishes to offer, reduce Version 2Q04: 08/18/04 unreasonably the total space available for physical collocation or preclude unreasonable reasonable physical collocation within the BellSouth Premises. Space shall not be available for collocation if it is: (a) physically occupied by non-obsolete equipment; (b) assigned to another collocated telecommunications carrier; (c) used to provide physical access to occupied space; (d) used to enable technicians to work on equipment located within occupied space; (e) properly reserved for future use, either by BellSouth or another collocated telecommunications carrier; or (f) essential for the administration and proper functioning of the BellSouth Premises. Otherwise, BellSouth shall attempt to accommodate PTLLC's ComSouth’s requested space preferences, if any, including the provision of contiguous space for any subsequent request for collocation. In allocating Collocation Space, BellSouth shall not materially increase PTLLC's ComSouth’s cost or materially delay PTLLC's ComSouth’s occupation and use of the Collocation Space, assign Collocation Space that will impair the quality of service or otherwise limit the service PTLLC ComSouth wishes to offer, reduce Version 2Q04: 08/18/04 unreasonably the total space available for physical collocation or preclude unreasonable reasonable physical collocation within the BellSouth Premises. Space shall not be available for collocation if it is: (a) physically occupied by non-non- obsolete equipment; (b) assigned to another collocated telecommunications carrier; (c) used to provide physical access to occupied space; (d) used to enable technicians to work on equipment located within occupied space; (e) properly reserved for future use, either by BellSouth or another collocated telecommunications carrier; or (f) essential for the administration and proper functioning of the BellSouth Premises. BellSouth may segregate Collocation Space and require separate entrances for collocated telecommunications carriers to access their Collocation Space, pursuant to FCC Rules.

In allocating Collocation Space, BellSouth shall not (a) materially increase PTLLCTelCove's cost or materially delay PTLLCTelCove's occupation and use of the Collocation Space, (b) assign Collocation Space that will impair the quality of service or otherwise limit the service PTLLC TelCove wishes to offer, (c) reduce Version 2Q04: 08/18/04 unreasonably the total space available for physical collocation at a Premise, or preclude unreasonable unreasonably physical collocation within the Premises. Consistent with the foregoing, BellSouth Premisesshall assign TelCove collocation space within Premises that utilizes existing infrastructure (e.g., HVAC, lighting and available power), if such space is available for collocation. Space shall not be available for collocation if it is: : (a) physically occupied by non-obsolete equipment; (b) assigned to another collocated telecommunications carrier; (c) used to provide physical access to occupied space; (d) used to enable technicians to work on equipment located within occupied space; (e) properly reserved for future use, either by BellSouth or another collocated telecommunications carrier; or (f) essential for the administration and proper functioning of the BellSouth Premises. BellSouth may segregate Collocation Space and require separate entrances for collocated telecommunications carriers to access their Collocation Space, pursuant to FCC Rules.

In allocating Collocation Space, BellSouth shall not materially increase PTLLCNOS Communications, Inc.'s cost or materially delay PTLLCNOS Communications, Inc.'s occupation and use of the Collocation Space, assign Collocation Space that will impair the quality of service or otherwise limit the service PTLLC NOS Communications, Inc. wishes to offer, reduce Version 2Q04: 08/18/04 unreasonably the total space available for physical collocation or preclude unreasonable physical collocation within the BellSouth Premises. Space shall not be available for collocation if it is: (a) physically Version 1Q03: 02/28/03 occupied by non-obsolete equipment; (b) assigned to another collocated telecommunications carrier; (c) used to provide physical access to occupied space; (d) used to enable technicians to work on equipment located within occupied space; (e) properly reserved for future use, either by BellSouth or another collocated telecommunications carrier; or (f) essential for the administration and proper functioning of the BellSouth Premises. BellSouth may segregate Collocation Space and require separate entrances for collocated telecommunications carriers to access their Collocation Space, pursuant to FCC Rules.

BellSouth shall assign PTLLC Iris Networks Collocation Space that utilizes existing infrastructure (e.g., heating, ventilation, air conditioning (HVAC), lighting and available power), if such space is available for collocation. Otherwise, BellSouth shall attempt to accommodate PTLLC's Iris Networks’s requested space preferences, if any, including the provision of contiguous space for any subsequent request for collocation. In allocating Collocation Space, BellSouth shall not materially increase PTLLC's Iris Networks’s cost or materially delay PTLLC's xxxxx Xxxx Networks’s occupation and use of the Collocation Space, assign Collocation Space that will impair the quality of service or otherwise limit the service PTLLC Iris Networks wishes to offer, reduce Version 2Q04: 08/18/04 unreasonably the total space available for physical collocation or preclude unreasonable reasonable physical collocation within the BellSouth Premises. Space shall not be available for collocation if it is: (a) physically occupied by non-obsolete equipment; (b) assigned to another collocated telecommunications carrier; (c) used to provide physical access to occupied space; (d) used to enable technicians to work on equipment located within occupied space; (e) properly reserved for future use, either by BellSouth or another collocated telecommunications carrier; or (f) essential for the administration and proper functioning of the BellSouth Premises. BellSouth may segregate Collocation Space and require separate entrances for collocated telecommunications carriers to access their Collocation Space, pursuant to FCC Rules.
