SPECIAL ELECTION FOR STANDARDIZED CODE SS. 401(k) Plan. If the Employer's Plan is a Standardized Code ss.401(k) Plan, the Employer may elect in Adoption Agreement Section 3.04 to apply the top heavy minimum allocation requirements of Section 3.04(B)(1) only for Plan Years in which the Plan actually is a top heavy plan.
