Common use of Special Notice to Offerors Clause in Contracts

Special Notice to Offerors. The Government's obligation under this contract is contingent upon the availability of funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the KO for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the KO. The Government reserves the right to begin services for the contract based upon funds available. The award will be based on the successful Offeror’s proposal submitted in accordance with Section L herein.
