Common use of Spectrum Management Clause in Contracts

Spectrum Management. 9.2.6.1 CenturyLink will provide 2/4 Wire non-loaded Loops, ISDN-capable Loops, xDSL-I-capable Loops, DS1-capable Loops, and DS3-capable Loops (collectively referred to in this Section 9.2.6 as "xDSL Loops") in a non-discriminatory manner to permit CLEC to provide Advanced Services to its End User Customers. Such Loops are defined herein and are in compliance with FCC requirements and guidelines recommended by the Network Reliability and Interoperability Council (NRIC) to the FCC, such as guidelines set forth in T1-417. 9.2.6.2 When ordering xDSL Loops, CLEC will provide CenturyLink with appropriate information using NC/NCI codes to describe the Power Spectral Density Mask (PSD) for the type of technology CLEC will deploy. CLEC also agrees to notify CenturyLink of any change in Advanced Services technology that results in a change in spectrum management class on the xDSL Loop. CenturyLink agrees CLEC need not provide the speed or power at which the newly deployed or changed technology will operate if the technology fits within a generic PSD mask. 9.2.6.2.1 CLEC information provided to CenturyLink pursuant to Section
