Standard of Care and Professional Conduct. The Contractor shall perform all Services hereunder in a professional manner, using the degree of care and skill ordinarily exercised by, and consistent with, the current professional practices and standards of a professional practicing in California. The Contractor will furnish, at its expense, the Services that is set forth in this Agreement and represents that the Services is within the technical and professional areas of expertise of the Contractor or any subcontractor the Contractor has engaged or will engage to perform the Services. If the District desires, the District shall request in writing, the Contractor to provide Services in addition to, or different from, the Services described herein. The Contractor shall advise the District in writing of any Services that, in the Contractor’s opinion, lie outside of the technical and professional expertise of the Contractor. The Services completed herein must meet the approval of the District and shall be subject to the District’s general right of inspection to secure the satisfactory completion thereof. Contractor or Contractor’s employees, subcontractors, or volunteers who are determined by the District to be uncooperative, incompetent, a threat to the adequate or timely completion of the Services described herein, a threat to the safety of persons or property, or any of Contractor’s employees, subcontractors, or volunteers who fail or refuse to perform the Services in a manner acceptable to the District, shall be promptly removed by the Contractor and shall not be contracted to perform this or any future Services for the District.
