State Entity. The University is an entity of the State of Missouri and, as such, no provision of the Agreement is intended to operate as a waiver or relinquishment of any right, privilege, or defense, including thedefense of sovereign immunity, afforded the University under constitutional provision or law or any other state or federal law. Coach acknowledges and agrees that pursuant to Missouri Revised Statutes § 172.250, the University is prohibited from creating any indebtedness in one year above what it can pay out of the income of said year;

To the extent that CLEC has such an Embedded Base, CLEC shall only augment trunk groups in the Embedded Base with the mutual agreement of the Parties.
