STATE POLICE LIEUTENANTS. (a) Employees who are required to work on a day which is normally a scheduled workday and is also a day observed as a legal holiday shall receive compensation at “designated rates” in addition to the minimum regular compensation, for all hours actually worked on that day up to a maximum of the number of hours in his/her regular workday. The compensation shall be in cash or in compensatory time off if the employee so chooses and if the employer can grant the compensatory time off. If the “designated rate” for the holiday is time and one-half and the employee requests compensatory time off for all hours actually worked that day, the employer may determine to pay for hours actually worked, in compensatory time off at straight time and four and one-half (4.5) hours in compensatory time off or cash at straight time. (b) If a legal holiday is observed on a day which is not normally a scheduled workday and the employee does not work on that day, he or she shall receive for that day his or her regular workday in cash, which shall be in addition to his or her regular compensation. The Department will attempt to accommodate an employee’s request for a compensatory tour of duty off in lieu of cash for such holiday, but may grant or deny such request based on its determination of the operating needs of the Department in relation to available staffing. (c) If a legal holiday is observed on a day which is not normally a scheduled workday and the employee does work on that day, he or she shall receive for the day his or her regular hourly rate for the number of hours in a regular workday at designated rates in cash, plus cash (or compensatory time off if the employee chooses and if the employer can grant the time off) at straight time rates for all hours worked not to exceed the regular workday. Such compensation shall be in addition to the employee’s minimum regular compensation. (d) Notwithstanding any contrary provisions of this Agreement, an employee who works “overtime” on a holiday (i.e., who works more than eight (8) hours on a holiday) shall be paid at the applicable rate pursuant to the Overtime Article.
