Statistical Phase Sample Clauses

Statistical Phase. Any and all remaining monies in the Pre-Arbitration Pool (after distributing bonuses during the Awards Phase described in subsection (a) above) will be allo- cated among eligible Players who rank in the top 100 in Wins Above Replacement (as calculated by the Pre-Arbitration Com- mittee pursuant to Section 4 below) (“Joint WAR”) among the universe of all eligible Players that season. In order to determine the amount of the bonus paid to each eligible Player who quali- fies for a bonus in this phase (because his Joint WAR in the recently completed season was among the 100 highest for eligi- ble Players that season), the total amount in the Pre-Arbitration Pool remaining after the distribution of any bonuses during the Awards Phase described in subsection (a) above will be multi- plied by a fraction, the numerator of which is the Joint WAR accrued by that eligible Player in the relevant season and the denominator of which is the total Joint WAR accrued by all xxx- gible Players who qualify for a bonus in this phase during that season (i.e., the cumulative Joint WAR among top 100 eligible Players).

The statistics shall meet or exceed the most recent project Counting Online Usage of NeTworked Electronic Resources ("COUNTER") Code of Practice Release,3 including but not limited to its provisions on customer confidentiality. When a release of a new COUNTER Code of Practice is issued, the Distributor shall ensure that the Publisher will comply with the implementation time frame specified by COUNTER to provide usage statistics in the new standard format. It is more than desirable that the Standardized Usage Statistics Harvesting Initiative (SUSHI) Protocol4 is available for the Licensee to harvest the statistics.
