Status of Environmental Consultant. 3.1.1 The School District has engaged the Environmental Consultant as an independent contractor to carry out the Work, and neither the Environmental Consultant nor any of the Environmental Consultant’s agents, employees or Subconsultants shall in any way or for any purpose whatsoever be deemed an agent or employee of the School District. Neither the Environmental Consultant nor any of its agents, employees or Subconsultants constitute employees of the School District, and these persons shall have no right to receive any School District employee benefits, or any other privileges available to School District employees. Neither the Environmental Consultant nor its agents, employees or Subconsultants shall represent themselves in any way as agents or employees of the School District, and none of the Environmental Consultant, its agents, employees or Subconsultants has any power to bind legally the School District to any third party. 3.1.2 The Environmental Consultant is an authorized representative of the School District on the assigned Project(s), and shall have the powers, duties and responsibilities that are delegated by the School District to the Environmental Consultant under this Contract.
