Stipulated Agreement. The recommended Order accepts the terms of Stipulated Agreement 1925, executed by the above named parties, which requires the installation of new automatic flashing light signals and gates and approach grade/alignment improvements at the 310th Avenue grade crossing near New Salem, Pike County. The project came to the attention of the Rail Safety Section via quantitative analysis by staff. The total estimated cost for the new automatic warning devices at the crossing is $327,906. Staff recommends that the Grade Crossing Protection Fund (GCPF) be used to pay 95% of the signal installation costs, not to exceed $311,511. Norfolk Southern will pay all remaining signal design and installation costs, and all future operating and maintenance costs related to the new automatic warning devices. Pike County, on behalf of New Salem Township Road District, has estimated the cost to improve the roadway approach grades/alignment at $160,000. Due to documented financial hardship, the Township cannot afford to pay any of the costs to rehabilitate the approach grades. Staff considers the rehabilitation of the approach grades important enough to recommend that the GCPF be used to pay 100% of the roadway approach grade rehabilitation costs, not to exceed $160,000. All required work is to be completed within eighteen (18) months from the Order date. I recommend entry of the attached Order. Attachment
Stipulated Agreement. Reference is made to that certain Stipulated Agreement, dated November 9, 1998 (the "STIPULATED AGREEMENT"), by and between the Administrator of the Iowa Racing and Gaming Commission and IWRA. In connection with the Stipulated Agreement, IWRA has conducted an investigation which included discussions with Current Manager, General Manager, licensed engineers and other contractors and professionals relating to implementing a plan for the modification of the exterior entrances of the Property to minimize the potential entry into gaming areas of the Property by underage individuals (the "MODIFICATIONS"). IWRA believes in good faith, following such investigation, that, in light of prudent business practices and the effect such Modifications may have upon customer traffic on the Property, the cost of designing, constructing and implementing reasonable Modifications that would be acceptable to the Gaming Commission will not exceed $150,000.00.

The total estimated cost of the highway approach grade improvements not to exceed $174,076. Staff recommends that the GCPF be used to pay 100% of the approach rehabilitation costs, in an amount not to exceed $174,076. IC will pay 5% of the cost to design and install the new crossing warning devices, and the cost of future maintenance of the signals and circuitry. The Village of Xxxxxxx will pay all costs of future maintenance of the rehabilitated approaches. All required work is to be completed within eighteen (18) months from the Order date. Stipulated Agreement. The recommended Order accepts the terms of Stipulated Agreement 1570, executed by the above named parties, which requires the installation of new automatic flashing light signals and gates at the 0000X Xxxx, Xxxxxxx Xxxx and 100E Road grade crossings of Norfolk Southern’s (NS) tracks in Champaign County, and the 1200E Road grade crossing of the NS tracks in Piatt County, Illinois. The project came to the attention of the Rail Safety Section via informal correspondence between Commission Staff and NS. The total estimated cost for the new automatic warning devices is $938,575. Staff recommends that the GCPF be used to pay 90% of the signal installation costs, not to exceed $844,718. Norfolk Southern Railway Company will pay all remaining installation costs, as well as all future operating and maintenance costs related to the new automatic warning devices. No local highway agency funds or work are required. All work is to be completed within eighteen (18) months from the Order date. I recommend entry of the attached Order. Attachment

The estimated cost to install the new automatic warning devices is $594,674. Staff recommends that the Grade Crossing Protection Fund (GCPF) be used to pay 95%, not to exceed $564,940, of the costs to install the new automatic warning devices at the crossing. UP will pay all remaining installation costs, as well as all future costs to maintain the new warning devices. Monroe County will not incur any cost associated with the safety improvements. All work is to be completed within twelve (12) months of the Order date. I recommend entry of the attached Order.

The project came to the attention of the Rail Safety Section via Staff analysis. The total estimated cost of the signal design and installation is $1,278,362. Staff recommends that the Grade Crossing Protection Fund (GCPF) be used to pay 95% of the signal design and construction costs, in an amount not to exceed $1,214,443, from the GCPF. CSX will pay 5% of the cost to design and install the new automatic warning devices, and the entire cost of future maintenance of the signals and circuitry. The total estimated cost to rehabilitate the existing highway approaches, to meet the minimum requirements of 92 Ill. Adm. Code 1535.204, is $119,046. Staff recommends that the GCPF be used to pay 100% of the approach design and construction costs, in an amount not to exceed $119,046, from the GCPF. The Township will be responsible for the costs and work of maintaining the highway approaches. All required work is to be completed within eighteen (18) months from the Order date. The Stipulated Agreement provides for the installation of automatic flashing light signals and gates, and improvement of the highway approaches, at the Xxxxxx Road grade crossing, located near De Xxxx, Jackson County. This project came to the attention of the Rail Safety Section via an application. The estimated cost to install the new warning devices is $187,465. Staff recommends the Grade Crossing Protection Fund be used to pay 95% of the warning device installation costs, not to exceed $178,092. Union Pacific Railroad Company will pay the remaining warning device installation costs, as well as all future operating and maintenance costs. The estimated cost to improve the highway approach grades is $69,000. Staff recommends the GCPF be used to pay 100% of the highway approach improvement costs, not to exceed $69,000. The Road District will be responsible for all remaining costs associated with improving the approach grades, as well as all future maintenance costs. Staff would normally recommend the Road District pay 10% of the installation costs for the new automatic warning devices, or recommend that the Road District pay for the roadway improvements. However, the Road District has provided sufficient evidence to prove that it is experiencing a severe financial hardship and cannot pay any portion of the project costs. Staff considers the proposed crossing safety improvements important enough to recommend that the GCPF be used to pay the Township’s portion of the project costs. All work is to be completed within twelve (12) months of the Order date. I recommend entry of the attached Order approving the Stipulated Agreement. Attachment JRS
