Storm Sewer System. (a) The Owner shall undertake the installation, repair, and perpetual maintenance of the private storm water system as identified in the Civil Plans, prepared by AM Candaras Associates Inc., dated June 7, 2018, attached hereto as Schedule ‘E’, and approved by the Director of Public Works. (b) All downspouts fronting the building shall not be directed towards the sidewalk and splash pads are required. (c) The storm sewer system must comply with the Region’s Sewer Use By- law #27-2014.

(b) The owner acknowledges and agrees that maintenance and replacement of the private storm sewer outlet pipe on the Regional Road Allowance is the responsibility of the owner of the property. The Region will take no responsibility for the private outlet pipe. (c) The owner acknowledges and agrees that the private storm sewer pipe shown on the approved site plan has a potential to allow Regional Road water to backflow onto their property if the Regional roadside ditch experiences an overflow. (d) The Niagara Peninsula Conservation Authority (NPCA) requires stormwater runoff must be treated to a Normal standard prior to discharge from the site. Provision must be made for stormwater quality controls. (e) The NPCA will require that post development stormwater peak flows be attenuated to pre-development levels for up to and including the 100 year storm event prior to discharge from the site. The NPCA has no objection to the proposal to further attenuate post development peak flows to the 2 year pre-development level. The NPCA has no objection to the proposal to utilize parking lot storage to achieve this criteria. The NPCA is satisfied that the NPCA’s quantity control requirements have been met.

(b) The Owner shall complete all storm system works, as specified in the Site Plan Agreement, prior to the construction of any structures within the development. (c) The Applicant shall enter into a formal easement agreement through the Municipality with the adjacent landowner to ensure the unimpeded drainage across the lands into the existing channel on the valley slope can continue in perpetuity. (d) The Applicant agrees to obtain all appropriate NPCA Work Permits for any works within the regulated areas prior to the commencement of the works on site (including but not limited to: works within 15m of the top of stable slope; any stormwater outfalls).
Storm Sewer System. The Parties acknowledge that the Development Area is not within CITY’s service area for the Storm Sewer System at the time of the execution of this Agreement. The Parties further acknowledge that a connection to the Storm Sewer System is not anticipated until such time that Dedicated Streets are constructed as part of the rezoning and replatting of either Lot 1 or Outlot A. Accordingly, DEVELOPER shall enter into an amendment to this Agreement pursuant to Section 6(C) prior to the construction of any Private or Public Improvement that requires connection to the Storm Sewer System.

Storm Sewer System. The Parties acknowledge that the Development Area is within CITY’s service area for the Storm Sewer System; however, DEVELOPER shall be responsible for maintaining those portions of the Storm Sewer System within the Development Area that are not within the public rights-of-way or within any perpetual drainage easements dedicated to CITY for roadway improvements or for the drainage and conveyance of stormwater and other runoff.
Storm Sewer System. The Parties acknowledge that the Development Area is within the Sarpy County service area for the Storm Sewer System; however, DISTRICT shall be responsible for maintaining those portions of the Storm Sewer System within the Development Area that are not within the public rights-of-way or within any perpetual drainage easements dedicated to Sarpy County for roadway improvements or for the drainage and conveyance of stormwater and other runoff.

(b) The Owner is responsible for annual inspections and maintenance of the underground storm chamber to ensure inlets are not plugged and remain functioning. (c) The Owner shall construct and install all erosion measures as shown on Schedule ‘E’ for the outlet of the proposed storm system into the existing ditch. (d) The Owner shall provide the Director of Public Works with as-built drawings showing the as-constructed location and elevations of all storm sewer system components within the public right-of-way.
