System Use. (a) An electronic site access system may be used on site, subject to the requirements of this statement. (b) The system operates via: (i) a facial recognition device; and (ii) an electronic gate. (c) The system will be installed at the access and egress point/s of the site and will only be utilised to identify presence on site. (d) The purpose for which the electronic site access system will be implemented is to ensure: (i) avoiding unauthorised access to site; (ii) confirmation and co-ordination of effort in emergency situations; and (iii) confirmation that all entrants to site have received a site specific induction; (e) The only personal data collected by the system is a site entrant’s: (i) image; (ii) first & last name; (iii) mobile phone number; (iv) email address; and (v) employer’s name. (the Collected Data) (f) The Collected Data will only be held or used for the purposes specified above, unless otherwise by consent or required by law. (g) The Employer will not use the electronic site access control system to verify who was on a site at a particular time for the purpose of: (i) evaluating whether a variation claim regarding labour costs made by a subcontractor can be substantiated; (ii) taking disciplinary action against an Employee, or assisting a subcontractor to take disciplinary action against its own employees, regarding their start and finish times; or (iii) otherwise generally tracking a worker’s movements whilst on the site.

System Use. Subject to the County’s obligations of Acceptance set forth in Attachment A.1 (Tasks and Deliverables) to Exhibit A (Statement of Work), and this Contract, following Solution Implementation by Contractor and prior to Final Acceptance by the County, the County will have the right to use, in a Production Use mode, any completed portion of the System, without any additional cost to the County where County determines that it is necessary for County’s operations. Such Production Use will not restrict Contractor’s performance under this Contract and will not be deemed Final Acceptance of the Solution.

System Use. (a) Establish the identity of the applicants and require each applicant to present the applicant’s immigration or naturalization documentation that contains the information (e.g., alien registration number) required by the SAVE Program; (b) Physically examine the documentation presented by the applicant and determine whether the document(s) reasonably appear(s) to be genuine and to relate to the individual; (c) Provide to the SAVE Program the information the SAVE Program requires to respond to User Agency requests for verification of immigration or naturalized or derived citizenship status information, including (1) information from the applicant’s immigration or naturalization documentation for initial automated verification, (2) additional information obtained from the alien's immigration or naturalization documentation for automated additional verification, and

SAVE will reject non-electronic (such as paper or fax) verification requests and information submissions; (d) Ensure and report to DHS-USCIS that, before using SAVE and whenever subsequently required by DHS-USCIS (for example, for SAVE system enhancements), all users performing verification procedures complete SAVE- required training including: reviewing the SAVE Program Guide, taking the latest version of Web tutorial(s) and maintaining a working knowledge of requirements contained therein and in this MOA, as updated; (e) Ensure users are provided with, maintain, and use SAVE user IDs only while they need them to perform verification procedures and promptly terminate the user’s access if the user separates from the User Agency or otherwise no longer needs SAVE access; (f) Ensure all users performing verification procedures only use SAVE with respect to verification of applicant immigration and naturalized or derived citizenship information for the specified benefit and comply with all other requirements contained in the SAVE Program Guide, web-based tutorial, and this MOA, and updates to these requirements; (g) Ensure that all users performing verification procedures have contact information for SAVE and DHS-USCIS; (h) Ensure all users perform any additional verification proc...

Prohibited uses include, but are not limited to: malicious or illegal activities; unauthorized access; the creation, sending and/or storing of fraudulent, threatening, harassing, or obscene messages; inappropriate mass mailing (spamming, flooding, bombing); denial of service attacks; and the creation or intentional distribution of computer viruses, worms, and/or Trojan horses.

System Use. Purchaser shall not alter, repair or permit the alteration or repair of the EVSE, remove, relocate or permit the removal or relocation of the EVSE, or make any attachments thereto, without Apex’s prior written consent, which Apex may grant or deny in its sole discretion or the system performance warranty shall become void. In the event of approval by Apex, Xxxxxxxxx agrees to pay for all associated costs of such removal or relocation, including but not limited to the oversight of Apex’s employees or agents, and Purchaser agrees to use a contractor approved by Apex for the work, if Apex does not do the work itself, under which conditions the performance warranty shall be upheld. Purchaser agrees to comply with all applicable laws, regulations, utility requirements and approvals relative to the EVSE. Purchaser will not make or permit to be made any use of the EVSE or any part thereof which would violate any of the covenants, agreements, terms, provisions and conditions of this Agreement or any manufacturer issued warranty, or which directly or indirectly is forbidden by law, ordinance or governmental regulation, including any zoning restrictions, or which may be dangerous to life, limb, or property. Purchaser shall be responsible for any misuse of the EVSE and any damage caused to the EVSE. System Use. User agrees to use the BCICS and maintain its County-assigned or User-owned radio equipment in accordance with Federal Communications Commission (FCC) rules and regulations and in accordance with BCICS policies and procedures. User agrees to use only those frequencies authorized by the County and further agrees to use the BCICS in a professional manner for official business purposes only. User shall attempt no modifications to county equipment unless authorized and shall not attempt to program or re-program equipment from the county or any source without the prior authorization of the County.
