Common use of Storm Water Clause in Contracts

Storm Water. 8.1 Notwithstanding any other provisions or terms of the Lease, Lessee acknowledges that the Airport is subject to federal storm water regulations, 40 CFR. Part 122, for "vehicle maintenance shops" (including vehicle rehabilitation, mechanical repairs, painting, fueling, and lubrication), equipment cleaning operations and/or deicing operations that occur at the Airport as defined in these regulations and, if applicable, state storm water regulations. Xxxxxx further acknowledges that it is familiar with these storm water regulations; that it conducts or operates "vehicle maintenance" (including vehicle rehabilitation, mechanical repairs, painting, fueling and lubrication), equipment cleaning operations and/or deicing activities as defined in the federal storm water regulations; and that it is aware that there are significant penalties for submitting false information, including fines and imprisonment for knowing violations. 8 .1.1 Notwithstanding any other provisions or terms of the Lease, Lessee acknowledges that it has taken steps necessary to apply for or obtain a storm water discharge permit as required by the applicable regulations for the Airport, including the Leased Premises operated by the Lessee. Lessee acknowledges that the storm water discharge permit issued to the Airport may name the Lessee as co-permittee. 8 .1.2 Notwithstanding any other provisions or terms of this Lease, including the Lessee's right to quiet enjoyment, County and Lessee both acknowledge that close cooperation is necessary to ensure compliance with any storm water discharge permit terms and conditions, as well as to ensure safety and to minimize costs. Lessee acknowledges that, as discussed more fully below, it may have to undertake to minimize the exposure of storm water (and snow melt) to "significant materials" generated, stored, handled or otherwise used by the Lessee, as defined in the federal storm water regulations, by implementing and maintaining "Best Management Practices." 8 .1.3 Lessee acknowledges that the Airport's storm water discharge permit is incorporated by reference into this Lease and any subsequent renewals.

Notwithstanding any other provisions or terms of this LeaseAgreement, including Concessionaire acknowledges that certain properties within the LesseeAirport, or on City-owned land, are subject to storm water rules and regulations. Concessionaire agrees to observe and abide by such storm water rules and regulations as may be applicable to City's right property and Concessionaire’s uses thereof. B. Concessionaire acknowledges that any storm water discharge permit issued to quiet enjoyment, County City may name Concessionaire as a co-permittee. City and Lessee Concessionaire both acknowledge that close cooperation is necessary to ensure insure compliance with any storm water discharge permit terms and conditions, as well as to ensure insure safety and to minimize costscost of compliance. Lessee Concessionaire acknowledges that, as discussed more fully below, further that it may have be necessary to undertake such actions to minimize the exposure of storm water (and snow melt) to "significant materials" generated, stored, handled or otherwise used by the LesseeConcessionaire, as such term may be defined in the federal by applicable storm water rules and regulations, by implementing and maintaining "Best Management Practicesbest management practices" as that term may be defined in applicable storm water rules and regulations." 8 .1.3 Lessee acknowledges that the Airport's C. City will provide Concessionaire with written notice of any storm water discharge permit requirements applicable to Concessionaire and with which Concessionaire will be obligated to comply from time-to-time, including, but not limited to: certification of non-storm water discharges; collection of storm water samples; preparation of storm water pollution prevention or similar plans; implementation of best management practices; and maintenance of necessary records. Such written notice shall include applicable deadlines. Concessionaire agrees that within thirty (30) days of receipt of such written notice it shall notify City in writing if it disputes any of the storm water permit requirements it is incorporated by reference into this Lease being directed to undertake. If Concessionaire does not provide such timely notice, Concessionaire will be deemed to assent to undertake such storm water permit requirements. In that event, Concessionaire agrees to undertake, at its sole expense, unless otherwise agreed to in writing between City and Concessionaire, those storm water permit requirements for which it has received written notice from City, and Concessionaire agrees that it will hold harmless and indemnify City for any subsequent renewalsviolations or non-compliance with any such permit requirements.
