Stormwater. Notwithstanding any other provisions or terms of this Agreement, Company acknowledges that certain properties within the Premises or on Authority-owned land are subject to stormwater rules and regulations. Company agrees to observe and abide by such stormwater rules and regulations as may be applicable to the Premises, and, if applicable, Company hereby expressly covenants, warrants, and represents to Authority, in connection with Company’s operations on the Premises, the following:
A. Company is required to submit a Notice of Intent to use the State of Florida Multi-Sector Generic Permit for Stormwater Discharge Associated with Industrial Activity. Authority and Company both acknowledge that close cooperation is necessary to ensure compliance with any stormwater discharge permit terms and conditions, as well as to ensure safety and to minimize the cost of compliance. Company acknowledges further that it may be necessary to undertake actions to minimize the exposure of stormwater to “significant materials” (as such term may be defined by applicable stormwater rules and regulations) generated, stored, handled, or otherwise used by Company by implementing and maintaining “best management practices” (BMPs) (as such term may be defined in applicable stormwater rules and regulations). Company will establish a BMP plan for the Premises and submit a copy to Authority.
B. Company will be knowledgeable of any stormwater discharge permit requirements applicable to Company and with which Company will be obligated to comply. The submittal of a Notice of Intent will be made by Company to the FDEP, and a copy will be submitted to Authority. Company is required to comply with the following requirements including, but not limited to, certification of non-stormwater discharges; collection of stormwater samples; preparation of a Stormwater Pollution Prevention Plan or similar plans; implementation of BMPs; and maintenance and submittal of necessary records. In complying with such requirements, Company will observe applicable deadlines set by the regulatory agency that has jurisdiction over the permit. Company agrees to undertake, at its sole expense, those stormwater permit requirements for which it has received written notice from the regulatory agency and that apply to the Premises, and Company agrees that it will hold harmless and indemnify Authority for any violations or non-compliance with any such permit requirements.
Stormwater. An on-site stormwater retention facility will be constructed in conjunction with the development. The stormwater retention facility will be maintained at a level consistent with the standards of the St. Xxxxx River Water Management District and Thethe City of Daytona Beach. Collection and transmission facilities shall be located pursuant to the approved site plan, or site plans approved for individual lots or structures.
Stormwater. Developer shall comply with City Code and the requirements of any other agency having jurisdiction of stormwater management and control. Generally offsite drainage and flows that flow onto and across the Project site shall not be impeded and their conveyance to the river maintained. Stormwater that falls on the hardscape developed portions of the Project site (such as buildings, roadways, and parking lots) shall be retained on site in accordance with City Code and Idaho DEQ standards. Undeveloped and natural areas shall generally retain their historic drainage function and flow paths to the extent reasonably possible. Developer’s stormwater plan will be reviewed and approved by the City Engineer and any other agency having jurisdiction thereof, as and when required by City Code.
Stormwater. (1) Notwithstanding any other provisions or terms of this Agreement, AIRLINE acknowledges that certain properties within the Airport, or on AUTHORITY owned land, are subject to stormwater rules and regulations. AIRLINE agrees to observe and abide by such stormwater rules and regulations as may be applicable to AUTHORITY’s property and uses thereof.
(2) AIRLINE acknowledges that any stormwater discharge permit issued to the AUTHORITY may name AIRLINE as a co-permitee. AUTHORITY shall notify AIRLINE prior to commencing National Pollutant Discharge Elimination System (NPDES) permit renewal discussions or negotiations. AUTHORITY and AIRLINE both acknowledge that close cooperation is necessary to insure compliance with any stormwater discharge permit terms and conditions, as well as to insure safety and to minimize cost of compliance. AIRLINE acknowledges further that it may be necessary to undertake such actions to minimize the exposure of stormwater to “significant materials” generated, stored, handled or otherwise used by AIRLINE, as such term may be defined by applicable stormwater rules and regulations, by implementing and maintaining “best management practices” as that term may be defined in applicable stormwater rules and regulations.
Stormwater. Add the following to this Clause:
Stormwater. Upon the Manitou PAA’s annexation to the City, the Tacoma Environmental Services Department’s Stormwater Management would take over the ownership and maintenance responsibility of the stormwater assets as set forth in Section 8 of this MOU.
Stormwater. Developer will comply with all stormwater and flood control ordinances, including but not limited to the Stormwater Management and Sediment Control Ordinance for Horry County, South Carolina; the Horry County Stormwater Management Design Manual, and the Horry County Flood Damage and Control Ordinance. The site design for the project shall minimize the generation of stormwater and maximize pervious areas, and stormwater management facilities shall be designed to reduce the 25-year, 24-hour developed peak discharge rates by twenty percent (20%) from the exiting peak discharge rates. In addition, the 100-year, 24-hour post-development peak discharge rates must not be greater than the pre- development peak discharge rates. Developer shall meet or exceed all County Stormwater Management and Sediment Control Ordinance requirements in effect as of the time of permitting.
Stormwater. The Property is being developed with privately maintained roads and a privately maintained drainage system. Stormwater runoff from the Project will be conveyed to on-site stormwater retention systems by means of grassed xxxxxx, curb gutters, and an underground drainage pipe system. The stormwater retention systems onsite may be interconnected with such systems on adjacent sites, subject to approval of the St. Xxxxx River Water Management District and the City. The City and Owner/Developer will coordinate at time of site plan or plat review to ensure that offsite drainage will not be affected by the onsite improvements.
Stormwater. The Property is being developed with a privately maintained Master Drainage System. Stormwater runoff from the Property may be conveyed to on-site stormwater detention systems by means of curb and gutter and an underground drainage pipe system. The Master Drainage System may be sized and permitted to accommodate the runoff from the Commercial Planning Area, consistent with all regulatory requirements. Pipe, structure materials and locations as well as pipe sizes shall be designed according to sound and generally accepted engineering principles and practices. Design and construction materials and methods of any off-site improvements associated with the Project are subject to the approval of the City. All ornamental landscape beds and lawn areas shall have supplemental irrigation. Provisions for the filtering of runoff of fertilizers, pesticides and chemicals into lakes, wetlands and storm water detention facilities shall be made which may include, but is not limited to, creation of a littoral planting shelf with appropriate upland and submergent species, detention berms prior to runoff entering water or other means deemed appropriate for the situation. A Stormwater Pollution Prevention Plan ("SWPPP”) shall be attached to and incorporated into the construction and permit documents for all projects constructed within the Property that require a general or individual SJRWMD permit. The SWPPP shall be implemented by the Owner upon initiation of construction activities and accommodate the specific construction project of the site.
Stormwater. A detailed drainage plan will be submitted as part of application for any development of the property. The plan will demonstrate compliance with the requirements of the Coburg Development Code and the applicable Master Planned Development plan.
