Street Pricing. The City requires that Concessionaire provide to customers high quality products and services and competitively price all products sold and services rendered from the Premises such that the prices are non-discriminatory and substantially comparable to average “street” prices for same, if available, or similar brands sold by retailers in the San Antonio metropolitan area so that customers do not expect to pay more for products and services in the Terminal than they would for average prices in locations outside the Terminal. Concessionaire agrees to adjust its prices to ensure that they meet the “street” pricing criteria in accordance with the City’s pricing policy and enforcement guidelines without any further notice or immediately upon written notice from the Director if Concessionaire is not in compliance therewith. Prior to opening for business, Concessionaire agrees to supply to the Director a detailed list of all products and services to be offered at the Premises and the prices to be charged therefor. Concessionaire agrees to continue to provide this data on an annual basis throughout the Term hereof. Concessionaire shall, at all times, observe and comply with the City’s street pricing policy as set forth in Exhibit E. Further, for the benefit of the users of the Terminal, the City has the right to promote a “free marketcompetitive environment within the Terminal and, to the extent possible, the City may cluster concession operators with similar products and services in groups to help stimulate competition, provide superior service and competitive pricing, and under no circumstances shall Concessionaire receive any type of “exclusives” or protection related thereto. To ensure that Concessionaire is in compliance with the quality of products, pricing and service standards set forth in this Section 8.02(c), and the City’s objectives are met, the City or its designated management representative may perform service audits, such as “mystery shopper programs,” of the conduct of Concessionaire’s operation in the Premises at any time. The results of such service audits performed on behalf of either the City may be employed by the City to enforce Concessionaire’s obligations hereunder. Street Pricing. Lessee shall post all prices charged for products sold and services performed in conspicuous places, and the prices shall be fair, reasonable and competitive with those generally charged by the operators of similar services in Fairfax and Loudoun Counties (the “Comparable Local Retail Area”). Lessee shall submit a schedule of fees and charges for all meals and products sold to the Authority from time to time if requested by the Authority in writing.
Street Pricing. 1. Lessee shall provide for the prominent display of gasoline, CNG and diesel retail prices. Prices shall be posted on each pump, so as to be visible to customers. Two service station monument signs, subject to the Authority’s approval, shall have prices for each type of fuel sold and shall be visible from Rudder Road and Ariane Way. 2. Lessee shall post all prices charged for gasoline, CNG, diesel fuels, and other products sold and services performed in conspicuous places, and the prices shall be fair, reasonable and competitive with those generally charged by the operators of service station facilities in Fairfax and Loudoun Counties (Comparable Local Retail Area). Lessee shall submit a schedule of fees and charges for all products sold and services performed to the Authority from time to time if requested by the Authority in writing. 3. Lessee may adjust and change its gasoline and other fuel prices from time to time during the Term. However, in order to monitor and measure whether the fuel pricing is set on a Comparable Local Retail Area basis, Lessee shall conduct a monthly market survey of fuel prices from like-branded gasoline stations within an 8-mile radius of the Facilities. The survey shall recite actual prices recorded within five (5) days of each other during the calendar month. Lessee shall maintain a competitive price structure that is not higher than the highest price for each type of fuel in the Comparable Local Retail Area. Lessee shall deliver the survey results to the Authority on a quarterly basis and the Authority may request the survey more often, in its sole discretion. If the survey indicates that the Lessee is not in compliance with the foregoing, Lessee will adjust its pricing accordingly, within five (5) calendar days. Failure to comply will constitute a Default. 4. If Lessee offers a rebate, discount or refund for cash only sales, versus payment by credit card, such method shall be posted in a conspicuous place on each pump. In addition, the employees at the Facilities shall verbally advise all cash paying customers of the rebate, discount or refund and apply such rebate, discount or refund as appropriate. 5. Lessee shall keep its convenience products store continuously stocked with high quality, saleable merchandise and establish prices that are no higher than prices charged at other like-branded service stations in the Comparable Local Retail Area.   • Unit Pricing If required by the Bid Specifications, the Bidder should insert the price per unit specified and the price extensions in decimals, not to exceed four places for each item unless otherwise specified, in the Bid. In the event of a discrepancy between the unit price and the extension, the unit price shall govern unless, in the sole judgment of the Commissioner, such unit pricing is obviously erroneous.

  • HOT LIST PRICING At any time during this Contract, Supplier may offer a specific selection of Equipment, Products, or Services at discounts greater than those listed in the Contract. When Supplier determines it will offer Hot List Pricing, it must be submitted electronically to Sourcewell in a line-item format. Equipment, Products, or Services may be added or removed from the Hot List at any time through a Sourcewell Price and Product Change Form as defined in Article 4 below. Hot List program and pricing may also be used to discount and liquidate close-out and discontinued Equipment and Products as long as those close-out and discontinued items are clearly identified as such. Current ordering process and administrative fees apply. Hot List Pricing must be published and made available to all Participating Entities.

  • TIPS Pricing Vendor agrees and understands that for each TIPS Contract that it holds, Vendor submitted, agreed to, and received TIPS’ approval for specific pricing, discounts, and other pricing terms and incentives which make up Vendor’s TIPS Pricing for that TIPS Contract (“TIPS Pricing”). Vendor confirms that Vendor will not add the TIPS Administration Fee as a charge or line-item in a TIPS Sale. Vendor hereby certifies that Vendor shall only offer goods and services through this TIPS Contract if those goods and services are included in or added to Vendor’s TIPS Pricing and approved by TIPS. TIPS reserves the right to review Vendor’s pricing update requests as specifically as line-item by line-item to determine compliance. However, Vendor contractually agrees that all submitted pricing updates shall be within the original terms of the Vendor’s TIPS Pricing (scope, proposed discounts, price increase limitations, and other pricing terms and incentives originally proposed by Vendor) such that TIPS may accept Vendors price increase requests as submitted without additional vetting at TIPS discretion. Any pricing quoted by Vendor to a TIPS Member or on a TIPS Quote shall never exceed Vendor’s TIPS Pricing for any good or service offered through TIPS. TIPS Pricing price increases and modifications, if permitted, will be honored according to the terms of the solicitation and Vendor’s proposal, incorporated herein by reference.

  • System Description The wet detention basin is designed to trap 80% of sediment in runoff and maintain pre-development downstream peak flows. The basin has two forebays (smaller ponds) located at the low end of two grass xxxxxx. In addition to runoff conveyance, the grass xxxxxx also allow infiltration and filtering of pollutants, especially from smaller storms. The forebays are each 4 feet deep. They are connected to the main pool by 18 and 24-inch metal pipes that outlet onto a rock chute. The forebays will trap coarse sediments in runoff, such as road sands, thus reducing maintenance of the main basin. The main pool will trap the finer suspended sediment. To do this, the pond size, water level and outlet structures must be maintained as specified in this Agreement (see Figures 1, 2 and 3). The main basin receives runoff from a 67.1 acre drainage area (41.2 acres within the subdivision and 25.9 acres off-site drainage coming from the east). During high rainfall or snow melt events, the water level will temporarily rise and slowly drain down to the elevation of the control structure. The water level is controlled by a 12-inch concrete pipe extending through the berm in the northwest corner of the basin (see Figures 1 and 3). On the face of the 12-inch pipe, there is metal plate with a 3-inch drilled hole (orifice) with stone in front of it. This orifice controls the water level and causes the pond to temporarily rise during runoff events. Washed stone (1- 2” diameter) is placed in front of the orifice to prevent clogging. High flows may enter the grated concrete riser or flow over the rock lined emergency spillway. “As-built” construction drawings of the basin, showing actual dimensions, elevations, outlet structures, etc. will be recorded as an addendum(s) to this agreement within 60 days after [Municipality Name] accepts verification of construction from the project engineer.

  • TECHNICAL EVALUATION (a) Detailed technical evaluation shall be carried out by Purchase Committee pursuant to conditions in the tender document to determine the substantial responsiveness of each tender. For this clause, the substantially responsive bid is one that conforms to all the eligibility and terms and condition of the tender without any material deviation.
