Subcontractor Selection. In the event YHI permits the Contractor to contract with any third party to perform any of Contractor's obligations to YHI, Contractor must make positive efforts to use small businesses, minority-owned firms, and women-owned businesses as sources of goods and services whenever possible. To this end, Contractor must place qualified small, minority-owned, and women-owned business enterprises on solicitation lists; ensure that small, minority-owned, and women--owned business enterprises are solicited whenever they are potential sources; consider contracting with consortia of small, minority-owned, or women-owned business enterprises when an intended contract is too large for any one such firm to handle on its own or, if economically feasible, divide larger requirements into smaller transactions for which such organizations might compete; make information on contracting opportunities available and establish delivery schedules that encourage participation by small, minority-owned, and women­ owned business enterprises; and use the services and assistance of the Small Business Administration and the Minority Business Development Agency, as appropriate. XXXXXXXX ANTI-KICKBACK ACT. The Contractor agrees to comply with the Xxxxxxxx Anti­Kickback Act, as amended, 18 U.S.C. 874, et seq., as supplemented in the DOL regulations 29 C.F.R. Part 3, which are hereby incorporated by reference. XXXXX-XXXXX ACT. If the Contractor performs more than $2,000 in construction, alteration, or repair services on public buildings or public works on behalf of YHI, it must comply with the Xxxxx-Xxxxx Xxx, 00 X.X.X. 0000 et seq., and implementing DOL regulations, 29 C.F.R. 5. The Xxxxx-Xxxxx Act requires contractors to pay wages to laborers and mechanics at a rate not less than the minimum wages specified in a wage determination made by the Secretary of Labor. The Xxxxx-Xxxxx Act also requires contractors to pay wages not less than once per week.
