Common use of Submission of Design Proposal Clause in Contracts

Submission of Design Proposal. ‌ (a) Immediately after the execution of this Agreement, the Concessionaire shall commence the preparation of the Design Proposal as per standards and specifications in line with the Scope of Work, attached as Schedule Z [Description of the Project & Scope of Work] in accordance with the provisions of this Agreement. (b) The design of the Project shall meet the accommodation requirements as defined under Rule 8 of the Accommodation Allocation Rules, 2002, at least for the FBR Reserved Apartments. (c) Project details, including number of Apartments, size and proportion of Apartments, commercial area etc. shall be in accordance with the plan submitted for bidding for the Project by the Concessionaire; (d) The Concessionaire shall submit for the approval of the FBR (which approval shall not be unreasonably withheld) the Design Proposal of the Works or parts thereof in accordance with provisions of Section 10.2. The Design Proposal will present the Concessionaire’s conceptual designs submitted by Concessionaire in its Proposal. The Concessionaire shall supply one plus four copies of the Design Proposal to FBR and Independent Engineer. The Design Proposal shall be carried forward to Detailed Design by the Concessionaire after approval of the Design Proposal by the Independent Engineer and FBR. The Detailed Design will also include details of all: (i) temporary works, including arrangements for diversion and control of traffic along, and public access across, any existing roads which are affected by the construction works; and (ii) timelines for removal of existing Public Utilities.
