Common use of Subscriber’s Obligations Clause in Contracts

Subscriber’s Obligations. By signing this Agreement, SUBSCRIBER will take all necessary precautions to maintain the security and integrity of the CLERK’S computer system. Specifically, SUBSCRIBER will educate users of their responsibility to keep access identification and password confidential, and to use the system only to fulfill their work duties on behalf of SUBSCRIBER. SUBSCRIBER is responsible for ensuring that its location or its terminal is not used by Unauthorized Users to access information from the Clerk’s subscriber site. Information accessed from subscriber site is for the use of SUBSCRIBER in the ordinary course of its business. The information is not intended or permitted to be commercially resold as the official governmental record required by law. In the event of a breach of this paragraph, CLERK is entitled to seek injunctive relief restraining SUBSCRIBER from accessing information from the subscriber site, and/or terminate this Agreement in accordance with Article 12 herein. This shall not be construed as prohibiting the CLERK from pursuing any other remedy available at law or equity for such breach. SUBSCRIBER is responsible for ensuring that use of the Clerk’s subscriber site by its Authorized Users is conducted in a proper and legal manner. If SUBSCRIBER is charged with a crime arising out of use of the subscriber site, CLERK shall have the right to terminate this Agreement immediately. This shall not be construed as prohibiting CLERK from pursuing any other remedy available at law or equity for such a breach. THE PUBLIC INFORMATION ON THE SUBSCRIBER SITE IS PROVIDED SUBJECT TO THE LAWS OF THE STATE OF FLORIDA.

This shall not be construed as prohibiting the CLERK from pursuing any other remedy available at law or equity for such breach. SUBSCRIBER is responsible for ensuring that use of the Clerk’s subscriber CLERK'S subscription site by its Authorized Users is conducted in a proper and legal manner. If SUBSCRIBER is charged with a crime arising out of the use of information obtained from the subscriber subscription site, CLERK shall have the right to terminate this Agreement immediately. This shall not be construed as prohibiting CLERK from pursuing any other remedy available at law or equity for such a breach. THE PUBLIC INFORMATION ON THE SUBSCRIBER SITE IS PROVIDED SUBJECT TO THE LAWS OF THE STATE OF FLORIDAis responsible for making timely advanced annual payment to CLERK in the applicable amount, as set forth in ARTICLE 8, PRICING.

This shall not be construed constructed as prohibiting the CLERK from pursuing any other remedy available at law or equity for such breach. SUBSCRIBER is responsible for ensuring that use of the Clerk’s subscriber site by its Authorized Users is conducted in a proper and legal manner. If SUBSCRIBER or one of its Authorized Users is charged with a crime arising out of use of the subscriber site, the CLERK shall have the right to terminate this Agreement immediately. This shall not be construed as prohibiting the CLERK from pursuing any other remedy available at law or equity for such a breach. THE PUBLIC INFORMATION ON THE SUBSCRIBER SITE IS PROVIDED SUBJECT TO THE LAWS OF THE STATE OF FLORIDA. SUBSCRIBER is responsible for pre-payment of the subscription fees in order to maintain active account status. The CLERK will invoice SUBSCRIBER prior to the subscription period end date for renewal. Payments must be received within 30 days of the due date or the SUBSCRIBER account will be terminated.

SUBSCRIBER shall upon execution of this Agreement make a one-time payment to the CLERK of $50.00 for SUBSCRIBER account setup and initiation under this Subscription as listed in Exhibit A. This is a non-refundable fee. SUBSCRIBER shall make timely advanced monthly payments to Monroe County Clerk of Courts in the amount of $15.00 per month for "viewing and printing", which shall cover the costs of accessing electronic indexes and images of Official Records and indexes of Court Records via the subscriber site (See Exhibit A). THE PUBLIC INFORMATION ON THE SUBSCRIBER SITE IS PROVIDED SUBJECT TO THE LAWS OF THE STATE OF FLORIDA.

SUBSCRIBER is responsible for ensuring that its location or its terminal is his/her access credentials and passwords are kept confidential, and are not used by Unauthorized Users to access information from the Clerk’s subscriber site. “Unauthorized Users” for the purposes of this Agreement shall be any person or entity other than SUBSCRIBER. Information accessed from subscriber site is for the use of SUBSCRIBER in the ordinary course of its his/her business. The information is not intended or permitted to be commercially resold represented in any circumstance or situation as the official governmental record required by law. A gap may exist between the time paper documents are filed in the CLERK’S office and when they are indexed and imaged on the subscriber site. In order to assure the accuracy of the data or information, SUBSCRIBER should consult the official governmental record. The CLERK disclaims all responsibility for incorrect images, data or any other misinformation accessed from this service. By accessing the subscriber site, SUBSCRIBER acknowledges and agrees that all activity by SUBSCRIBER will be logged, tracked and monitored by CLERK. SUBSCRIBER is not permitted to use, or allow others to use, information obtained from the subscriber site for commercial or resale purposes. In the event of a breach of this paragraph, paragraph CLERK is entitled to seek injunctive relief restraining SUBSCRIBER from accessing information from form the subscriber site, and/or terminate this the Agreement in accordance with Article 12 14 herein. This shall not be construed as prohibiting the CLERK from pursuing any other remedy available at law or equity for such breach. SUBSCRIBER is responsible for ensuring that use of the Clerk’s subscriber site by its Authorized Users is conducted in a proper and legal manner. If SUBSCRIBER is charged with a crime arising out of use of the subscriber site, CLERK shall have the right to terminate this Agreement immediately. This shall not be construed as a prohibiting CLERK from pursuing any other remedy available at law or equity for such a breach. SUBSCRIBER shall safeguard his/her access credentials and password. SUBSCRIBER shall notify CLERK immediately if access credentials or password are compromised. THE PUBLIC INFORMATION ON THE SUBSCRIBER SITE IS RECORDS AND COURT RECORDS ARE PROVIDED SUBJECT TO THE LAWS OF THE STATE OF FLORIDAFLORIDA AND RULES OF COURT.
