Common use of Subtenant Surcharges Clause in Contracts

Subtenant Surcharges. During the Term, Subtenant shall pay to Sublandlord, as Additional Rent hereunder, all amounts payable for "Subtenant Surcharges," as that term is defined below. "Subtenant Surcharges" shall mean (a) any and all amounts other than Base Rent, Insurance Expenses, Real Property Taxes and Operating Expenses which become due and payable by Subtenant to Sublandlord hereunder, and (b) any and all amounts which become due and payable by Sublandlord to the Landlord under the Master Lease as additional charges which would not have become due and payable but for the acts and/or failures to act of Subtenant under this Sublease, including, but not limited to, any additional charges under the Master Lease payable by Sublandlord on account of (i) Subtenant's use of water, electricity, gas, elevator, heating, ventilation or air conditioning, refuse removal or any other utilities or services, (ii) late charges and/or default interest as set forth in the Master Lease arising from Subtenant's failure to make payments to Sublandlord as and when required hereunder, or (iii) the use by Subtenant of any above standard services or additional services with respect to the Building or the Subleased Premises. Subtenant shall pay the Subtenant Surcharges set forth above within ten (10) days after the presentation of statements therefor by the Landlord or Sublandlord to Subtenant.

Subtenant Surcharges. During the Term, Subtenant shall pay to Sublandlord, as Additional Rent hereunderadditional rent, all amounts the amount payable to Landlord for "Subtenant Surcharges," Surcharges (as that term is defined below). The term "Subtenant SurchargesSUBTENANT SURCHARGES" shall mean (ai) any and all amounts other than Base Rent, Insurance Expenses, Real Property Taxes Basic Rent and Operating Expenses and Taxes and Insurance which become due and payable by Subtenant to Sublandlord hereunder, and (bii) any and all amounts which become due and payable by Sublandlord to the Landlord under the Master Lease as additional charges which would not have become due and payable but for the acts and/or failures to act of Subtenant under this Sublease, Sublease including, but not limited to, any additional charges under the Master Lease payable by Sublandlord on account of (i1) Subtenant's use of water, electricity, gas, elevator, heating, ventilation or air conditioning, refuse removal conditioning or any other utilities or servicesbuilding services in excess of those provided at no additional charge pursuant to Article 7 of the Original Lease, (ii2) late charges and/or default interest as set forth in Section 2.6 of the Master Lease arising from Subtenant's failure to make payments to Sublandlord as and when required hereunderOriginal Lease, or (iii3) the use by Subtenant of any above standard services or additional services with respect to the Building or the Subleased PremisesSublease Premises or any services or additional services, or (4) parking and signage charges or fees. Subtenant shall pay the Subtenant Surcharges set forth above within ten (10) days after the presentation of statements therefor by the Landlord or Sublandlord to Subtenant.

Subtenant Surcharges. During the Term, Subtenant shall also pay to Sublandlord, Sublandlord the Subtenant Surcharges (as Additional Rent hereunder, all amounts payable for "Subtenant Surcharges," as that term is defined below). As used herein, "Subtenant Surcharges" shall mean mean: (ai) any and all amounts other than Base Rent, Insurance Expenses, Real Property Taxes Basic Rent and Tenant's Proportionate Share of Operating Expenses which become due and payable by Subtenant to Sublandlord hereunder, ; and (bii) any and all amounts which become due and payable by Sublandlord Tenant to the Landlord under the Master Lease and/or Sublandlord to Tenant under the Sublease as additional charges which would not have become due and payable but for the acts and/or failures to act of Subtenant under this Sublease, Sub-Subleases including, but not limited to, any additional charges under the Master Lease and/or Sublease payable by Sublandlord on account of (ia) Subtenant's use of water, electricity, gas, elevator, heating, ventilation or air conditioning, refuse removal conditioning or any other utilities or servicesbuilding services in excess of those provided pursuant to Section 15(C) of the Original Lease, (iib) late charges and/or and default interest as set forth in Sections 26(C) and (D) of the Master Lease arising from Subtenant's failure to make payments to Sublandlord as and when required hereunderOriginal Lease, or and/or (iiic) the use by Subtenant of the Building or the Premises or any above standard services or additional services with respect (in addition to the Building or the Subleased Premisesthose specified in subsection (a), above). Subtenant shall pay the Subtenant Surcharges set forth above within ten (10) days after the presentation of statements therefor by the Landlord Landlord, Tenant or Sublandlord to Subtenant.

During the Sublease Term, Subtenant shall pay to Sublandlord, as Additional Rent hereunderRent, all any amounts payable to Sublandlord or the Master Landlord (as the case may be) for "Subtenant Surcharges (as defined below). The term “Subtenant Surcharges," as that term is defined below. "Subtenant Surcharges" ” shall mean (ai) any and all amounts other than Base Sublease Rent, Insurance Expenses, Real Property Taxes and Operating Expenses and Building common area maintenance fees which become due and payable by Subtenant to Sublandlord hereunder, and (bii) any and all amounts which become due and payable by Sublandlord to the Master Landlord under the Master Lease as additional charges which would not have become due and payable but for the acts and/or failures to act of Subtenant under this Sublease, Sublease including, but not limited to, any additional charges under the Master Lease payable by Sublandlord on account of (i1) Subtenant's ’s use of water, electricity, gas, elevator, heating, ventilation or air conditioning, refuse removal or any other utilities or servicesbuilding services in excess of those provided at no additional charge pursuant to the Lease, (ii2) late charges and/or default interest as set forth in the Master Lease arising from Subtenant's failure to make payments to Sublandlord as and when required hereunderLease, or (iii3) the use by Subtenant of any above standard services or additional services with respect to the Building or the Subleased PremisesPremises or any services or additional services, or (4) parking and signage charges or fees.
