Successor Liquidating Trustee. In the event the Liquidating Trustee is removed or resigns pursuant to this Agreement or the Liquidating Trustee otherwise vacates his position, the Liquidating Trust Advisory Board shall designate a successor Liquidating Trustee who shall be subject to the approval of the Bankruptcy Court. Thereupon, such successor Liquidating Trustee shall, without any further act, become vested with all the estate, properties, rights, powers, trusts and duties of his/her predecessor in the Liquidating Trust with like effect as if originally named herein; provided, however, that a removed or resigning Liquidating Trustee shall, nevertheless, when requested in writing by the successor Liquidating Trustee, execute and deliver any reasonable instrument or instruments conveying and transferring to such successor Liquidating Trustee all the estate, properties, rights, powers, and trusts of such removed or resigning Liquidating Trustee.
