Common use of Successors to Client Clause in Contracts

Successors to Client. Any entity resulting from any consolidation, merger, amalgamation, arrangement, reorganization or other business combination to which the Client or a Fund, as the case may be, may be a party, or an entity to which all or substantially all of the business and assets of the Client or a Fund, as the case may be, may be transferred, shall be the successor to the Client or the Fund, as the case may be, hereunder, without the execution or filing of any instrument or performance of any further act or formality, provided that the Client gives prior written notice to the Custodian.
