Common use of Suicide or Misstatement Clause in Contracts

Suicide or Misstatement. Notwithstanding any provision of this Agreement to the contrary, the Company shall not pay any death benefit under this Agreement exceeding the Deferral Account if the Executive commits suicide within two years after the date of this Agreement, or if the Executive has made any material misstatement of fact on any application for life insurance purchased by the Company.

Notwithstanding any provision of this Agreement to the contrary, the Company shall not pay distribute any death benefit under this Agreement exceeding in excess of the Deferral Account Deferrals if the Executive commits suicide within two (2) years after the date of this AgreementEffective Date, or if an insurance company which issued a life insurance policy covering the Executive has made any and owned by the Company denies coverage (i) for material misstatement misstatements of fact made by the Executive on any an application for such life insurance purchased by the Companyinsurance, or (ii) for any other reason.
