Superior Encumbrances. Lessor further covenants, warrants and represents that there are no liens, mortgages or encumbrances on the Demised Premises superior to the rights of Lessee under this Lease, except as set forth in Article 20.1 hereinbelow and for the lien of a first mortgage which may have been heretofore or may hereafter be made by Lessor.

Superior Encumbrances. Lessor further covenants, warrants and represents that there are no monetary liens, mortgages or encumbrances on the Land or the remainder of the Shopping Center superior to the rights of Lessee under this Lease, except for the liens of a first and/or second mortgage on the Shopping Center, which may have been heretofore or may hereafter be made by Lessor and have been previously disclosed in writing by Lessor to Lessee.

  • LIENS; ENCUMBRANCES Borrower acknowledges that, to the extent provided in Section 21, the grant, creation or existence of any mortgage, deed of trust, deed to secure debt, security interest or other lien or encumbrance (a "Lien") on the Mortgaged Property (other than the lien of this Instrument) or on certain ownership interests in Borrower, whether voluntary, involuntary or by operation of law, and whether or not such Lien has priority over the lien of this Instrument, is a "Transfer" which constitutes an Event of Default and subjects Borrower to personal liability under the Note.
