Supplier’s Right to Change Brands, Discontinue Products, and Add New Products. Supplier shall have the right at any time to change, alter or amend any of the trademarks and trade names under which the Products are now or may hereafter be sold. If Supplier discontinues marketing any Product in any area in which Marketer distributes the Products, Supplier shall be relieved of all obligations to sell or deliver the discontinued Product to Marketer in the relevant area. If Supplier markets in such area any other motor fuel product in lieu of a discontinued Product or in addition to the Products (a “New Product”), then this agreement shall embrace the New Product and all of the terms and conditions of this agreement applicable to the Products (or previously applicable to any discontinued Product) shall apply to the New Product. Discontinued Products and New Products may include product grades and categories, and biofuels or other renewable or alternative fuels.
