Common use of Survival of Conditions of Approval Clause in Contracts

Survival of Conditions of Approval. If Developer proceeds with the construction of the Project, the obligations and requirements imposed by the conditions of approval set forth in the attached Exhibits “D,” “F-1,” and “F-2,” shall survive the expiration of the Term of this Agreement and shall remain binding on Developer, its successors and assigns, and shall continue in effect for the Life of the Project. Notice of the conditions of approval shall be recorded by the City separately and concurrently with this Agreement.

Notice of the conditions of approval shall be recorded by the City separately and concurrently with this Agreement.

If Developer proceeds with the construction of the Project, except as otherwise expressly limited in this Agreement, the obligations and requirements imposed by the conditions of approval set forth in the attached Exhibits Exhibit “D,” “F-1,” and “F-2,” shall survive the expiration of the Term of this Agreement and shall remain binding on Developer, its successors and assigns, and shall continue in effect for the Life of the Project. Notice of the conditions of approval shall be recorded until released by the City separately and concurrently with this AgreementPlanning Director.
