Common use of Survival of Payment Obligations Clause in Contracts

Survival of Payment Obligations. All payment obligations of the Company under the Existing Agreements (including, without limitation, reimbursement obligations in respect of costs, expenses and fees of or incurred by the holders of the Existing Notes), other than the obligation to pay the principal of and interest and Make-Whole Amount on the Existing Notes (which obligations, after the Effective Date, shall be evidenced by the Notes) shall survive the amendment and restatement of the Existing Agreements and the Existing Notes (and the cancellation thereof).
