Common use of SUSPENSION BY OWNER FOR CONVENIENCE Clause in Contracts

SUSPENSION BY OWNER FOR CONVENIENCE. (a) Subject to Article 23.03(b) above, Owner may, without cause, order the Contractor in writing to suspend, delay or interrupt the Work in whole or in part for a continuous period of up to 120 days. (b) An equitable adjustment may be made to the Contract Sum if deemed appropriate by Owner, in its sole discretion, to account for reasonable and proven direct costs incurred by Contractor as a result of such a suspension of the Work. An adjustment of the Contract Sum may include a deductive adjustment in proportion to the amount of the Work actually completed by Contractor. No adjustment shall be made to the extent: (1) that performance is, was or would have been so suspended, delayed or interrupted by another cause for which the Contractor is responsible; or (2) that adjustment has already been made or denied under another provision of this Agreement.
