Common use of Suspension of the AECS Clause in Contracts

Suspension of the AECS. 6.1. Without prejudice to the provisions of the AECS Agreement, we will have the right to suspend the AECS immediately by notice in writing, if the Contracting Retailer has not paid to us any sum it must pay us under the Contract on or before the due date. If we suspend the Agreed AECS in accordance with this paragraph, the provisions of the Contract relating to Eligible Credit Support shall apply without the Agreed AECS. 6.2. Without prejudice to the provisions of the AECS Agreement, the AECS will be restored after being suspended under subparagraph 6.1 above if the Contracting Retailer: a) has paid to us all the sums it must pay us under the Contract on or before the due date in respect of the three consecutive settlement runs that follow the suspension of the AECS by us; and b) no sum owed to us by the Contracting Retailer remains outstanding at the time.
