Common use of System Impact Study Agreement and Cost Reimbursement Clause in Contracts

System Impact Study Agreement and Cost Reimbursement. (i) The System Impact Study Agreement shall clearly specify the applicable charge, based on the Transmission Provider's estimate of the actual cost and the time for completion of the System Impact Study. The charge shall not exceed the actual cost of the study. In performing the System Impact Study, the Transmission Provider shall rely, to the extent reasonably practicable, on existing transmission planning studies. The Eligible Customer shall not be assessed a charge for such existing studies; however, the Eligible Customer shall be responsible for charges associated with any modifications to existing planning studies that are reasonably necessary in order to evaluate the impact of the Eligible Customer's service request on the Transmission System. (ii) If in response to multiple Eligible Customers requesting service in relation to the same competitive solicitation, a single System Impact Study is sufficient for the Transmission Provider to accommodate the service requests, the costs of that study shall be pro-rated among the Eligible Customers. (iii) For System Impact Studies that the Transmission Provider conducts on its own behalf, the Transmission Provider shall record the cost pursuant to Section 8.

The actual charge shall not exceed the actual cost of the study. In performing the System Impact Study, the Transmission Provider System Operator and the affected Participants shall rely, to the extent reasonably practicable, on existing transmission planning studies. The Eligible Customer shall will not be assessed a charge for such existing studies; however, the Eligible Customer shall will be responsible for charges associated with any modifications to existing planning studies that are reasonably necessary in order to evaluate the impact of the Eligible Customer's request for service request on the NEPOOL Transmission System. (ii) If in response to multiple Eligible Customers requesting service in relation to the same competitive solicitation, a single System Impact Study is sufficient for the Transmission Provider System Operator and the affected Participants to accommodate the service requests, the costs of that study shall be pro-rated prorated among the Eligible Customers. (iii) For System Impact Studies that the System Operator and any affected Participants conduct on behalf of a Participant which is a Transmission Provider conducts on its own behalfProvider, the Transmission Provider shall Participant will record the cost of the System Impact Studies pursuant to Section 88.5.
