Task 9: Services During Construction. Consultant shall provide services during construction (SDCs) as defined below. These services are intended to assist the City in responding to design-related questions that occur during construction. These SDCs are based upon the understanding that the City will contract directly with the construction Consultant, and that the City will to administer the construction contract, make decisions, provide approvals, and perform other actions necessary for the completion of the construction. This scope assumes that Consultant as the Engineer, is not the Construction Manager. Consultant's SDC are based upon the schedule and duration of construction as shown on the attached schedule. Deviations from the anticipated schedule or duration of construction will materially affect the scope of services and may require an adjustment to Consultant's compensation for SDCs. Consultant will not be responsible for the means, methods, techniques, sequences or procedures of the construction Contractor, nor shall the Consultant be responsible for the Contractor's failure to perform in accordance with the contract documents. Consultant's SDCs are based upon the City executing a contract for construction with a Consultant that is consistent with Consultant's agreement with the City, and which provide the requisite authority for Consultant to fulfill their SDCs responsibilities. This scope assumes that the following construction management and engineering services during construction will be performed by Engineer.
