Tax Change Not a Breach. Notwithstanding anything to the contrary expressed or implied in this Section 12, any change in the rate of an existing Tax or the assessment of a new or additional Tax on the Company, the Contractors or the Foreign Lenders in excess of the rate for such Tax expressly provided under this Section 12, if any, shall not be a breach of this Agreement by the GOB; provided, that the charge in rate or assessment of a new Tax in excess of the rate provided hereunder is the basis for an adjustment in the compensation payable to the Company under the Power Purchase Agreement thereof.
