Tax Credit Financing. Notwithstanding the restrictions on transfer of any interest in a Phase by sublease or otherwise or financing a Phase, in connection with any tax credit financing with respect to the affordable units to be constructed pursuant to Section 5.1, Developer may sublease such Phase and any such sublease of such Phase pursuant to a structure which will allow tax credit financing to be accomplished, shall not require approval of the CRA under this Lease.
