Common use of Temporary Construction Licenses Clause in Contracts

Temporary Construction Licenses. Insofar as it has the right to do so, CSXT hereby grants Agency a nonexclusive license to access and cross CSXT’s property, to the extent necessary for the construction of the Project (excluding ingress or egress over public grade crossings), along such routes and upon such terms as may be defined and imposed by CSXT and such temporary construction easements as may be designated on the Plans approved by CSXT.

Temporary Construction Licenses. Insofar as it CSXT has the right to do so, CSXT hereby grants Agency DEPARTMENT a nonexclusive license to access and cross CSXT’s 's property, to the extent necessary for the construction of the Project Project, subject to the applicable terms, conditions and limitations of the Special Provisions: (1) to the area and for the purposes described by temporary construction easements expressly delineated by the Plans, excluding ingress or egress over public grade crossings), along such routes tracks; and upon such terms (2) to ingress or egress over tracks as may be defined and imposed permitted by CSXT and such temporary construction easements as may be designated on pursuant to the Plans approved by CSXTSpecial Provisions.
