TEMPORARY CONTROLS. A. Construction Manager shall provide pumping, temporary drainage, water diversion, weather protection and controls as required to ensure not to delay the Work or the work of other contractors. B. Construction Manager shall keep the premises free from the accumulation of debris, rubbish and other waste material caused by Construction Manager, subcontractors and suppliers and remove all such material from the Project Site at least once every week. In addition, the building concrete floor when constructed shall be kept free from the accumulation of dust and dirt and shall be broom cleaned at least once every week. Should Construction Manager fail to provide cleaning as prescribed, Project Manager may arrange for the cleaning and the costs thereof shall be deducted from the Contract Sum. Should a dispute arise between Construction Manager and other contractors as to the responsibility for cleaning, Project Manager may arrange for the cleaning and the portion of the cost thereof, as Project Manager determines to be just, shall be deducted from the Contract Sum. C. Construction Manager shall take all precautions and provide all protection necessary to ensure that the building concrete floor will not be marked, spotted, stained or damaged in any way.

TEMPORARY CONTROLS. A. Cleaning During Construction: Contractor at all times shall keep the premises free from accumulation of waste materials and rubbish caused by operations for the Work. Provide a collection can at each area used for eating. Pick up garbage daily. Keep Project Site free of garbage, trash, vermin and rodent infestation. Contractor, by agreement, shall require each Subcontractor to collect and deposit waste and rubbish caused by Subcontractor operations at pre-designated location. Clean interior areas prior to start of finish Work. Maintain areas free of dust and other contaminates during finishing operations. B. Noise Control: In and around occupied areas, minimize use of noise producing equipment. Work with noise-producing is subject, at all times, to the ODR's approval of entire procedure. Use only on a scheduled basis as agreed with the ODR prior to start of Construction operations. C. Water Control: Provide methods to control surface water to prevent damage to the Project and adjoining properties. Control fill, grade and ditch to direct surface drainage away from excavations, pits, tunnels and other construction areas. Direct drainage to proper runoff. 1. Provide, operate and maintain hydraulic equipment of adequate capacity to control surface and water. 2. Dispose of drainage water in a manner to prevent flooding, erosion or other damage to any portion of Site or to adjoining areas. 3. Refer to the appropriate section in Division 2 of these Specifications for TPDES requirements.

  • TIA Controls If any provision of this Indenture limits, qualifies, or conflicts with another provision which is required to be included in this Indenture by the TIA, the required provision shall control.

  • Security Controls Annually, upon Fund’s reasonable request, DST shall provide Fund’s Chief Information Security Officer or his or her designee with a summary of its corporate information security policy and an opportunity to discuss DST’s information security measures, and a high level and non-confidential summary of any penetration testing related to the provision of in-scope services . DST shall review its Security Policy annually.

  • Exchange Control Requirements You understand and agree that, pursuant to local exchange control requirements, you will be required to repatriate the cash proceeds from the sale of the Shares issued to you upon settlement of the Units and from the receipt of any dividends or Dividend Equivalents to China. You further understand that, under applicable laws, such repatriation of your cash proceeds will need to be effectuated through a special exchange control account established by the Company or any Affiliate, including the Employer, and you hereby consent and agree that any proceeds may be transferred to such special account prior to being delivered to you. You also understand that the Company will deliver the proceeds to you as soon as possible, but that there may be delays in distributing the funds to you due to exchange control requirements in China. Proceeds may be paid to you in U.S. dollars or local currency at the Company's discretion. If the proceeds are paid to you in U.S. dollars, you will be required to set up a U.S. dollar bank account in China so that the proceeds may be deposited into this account. If the proceeds are paid to you in local currency, the Company is under no obligation to secure any particular currency conversion rate and the Company may face delays in converting the proceeds to local currency due to exchange control restrictions. You further agree to comply with any other requirements that may be imposed by the Company in the future in order to facilitate compliance with exchange control requirements in China.

  • Technical Security Controls 35 a. Workstation/Laptop encryption. All workstations and laptops that store PHI COUNTY 36 discloses to CONTRACTOR or CONTRACTOR creates, receives, maintains, or transmits on behalf of 37 COUNTY either directly or temporarily must be encrypted using a FIPS 140-2 certified algorithm which 1 is 128bit or higher, such as AES. The encryption solution must be full disk unless approved by the 2 COUNTY.

  • Controls Each party will maintain commercially reasonable administrative, technical, and physical controls designed to protect data in its possession or under its control from unauthorised access, accidental loss and unauthorised modification.   • Exchange Controls As a condition to this grant of Units, the Employee agrees to comply with any applicable foreign exchange rules and regulations.

  • Indenture Controls If and to the extent that any provision of the Notes limits, qualifies or conflicts with a provision of this Indenture, such provision of this Indenture shall control.

  • Agreement Controls In the event that any term of any of the Loan Documents other than this Agreement conflicts with any express term of this Agreement, the terms and provisions of this Agreement shall control to the extent of such conflict.
