Common use of Tenant’s Participation Clause in Contracts

Tenant’s Participation. Landlord is entitled to receive and keep all damages, awards or payments resulting from or paid on account of a Taking. Accordingly, Tenant waives and assigns to Landlord any interest of Tenant in any such damages, awards or payments. Tenant may prove in any condemnation proceedings and may receive any separate award for damages to or condemnation of Tenant’s movable trade fixtures and equipment and for moving expenses; provided however, that Tenant has no right to receive any award for its interest in this Lease or for loss of leasehold.

Tenant may prove in any condemnation proceedings and may receive any a separate award or compensation for damages to or condemnation Taking of Tenant’s movable trade fixtures and equipment and Personal Property, for moving expensesand relocation benefits, and the good will of Tenant (which together compromise the business value of Tenant), which Tenant may initiate and pursue at Tenant’s sole cost and expense; provided provided, however, that the Tenant has no right to receive any award for its interest in this Lease or for loss of leaseholdits leasehold estate.
