Common use of TENANT’S PRIMARY DUTY Clause in Contracts

TENANT’S PRIMARY DUTY. All agreements and covenants to be performed or observed by Tenant under this Lease shall be at Tenant's sole cost and expense and without any abatement of rent, except as expressly provided herein. If Tenant fails to pay any sum of money to be paid by Tenant or to perform any other act to be performed by Tenant under this Lease after notice and the passage of any applicable cure period, Landlord shall have the right, but shall not be obligated, and without waiving or releasing Tenant from any obligations of Tenant, to make any such payment or to perform any such other act on behalf of Tenant in accordance with this Lease. All sums so paid by Landlord and all necessary incidental costs shall be deemed additional rent hereunder and Tenant shall pay the same to Landlord on written demand, together with interest on all such sums from the date of expenditure by Landlord to the date of repayment by Tenant at the Interest Rate.

All sums so paid by Landlord and all necessary incidental costs incurred or paid by Landlord shall be deemed additional rent hereunder and Tenant shall pay the same to Landlord on written demand, together with interest on all such sums and costs from the date of expenditure by Landlord to the date of repayment by Tenant at the Interest Raterate of ten percent (10%) per annum.

If Tenant fails an Event of Default occurs hereunder as a consequence of Tenant’s failure to pay any sum of money to be paid by Tenant or to perform any other act to be performed by Tenant under this Lease after notice and the passage of any applicable cure periodLease, Landlord shall have the right, but shall not be obligated, and without waiving or releasing Tenant from any obligations of Tenant, to make any such payment or to perform any such other act on behalf of Tenant in accordance with this Lease.
