Common use of Tender Prices Clause in Contracts

Tender Prices. 2.9.1 The tenderer shall indicate on the appropriate Price Schedule the unit prices where applicable and total tender price of the goods and installation it proposes to supply under the Framework Agreement. 2.9.2 Prices indicated on the Price Schedule shall be entered separately in the following manner: (i) the price of the goods quoted EXW (ex works, ex factory, ex warehouse, ex showroom, or off-the-shelf, as applicable), including all customs duties and sales and other taxes already paid or payable: (ii) charges for inland transportation, insurance, and other local costs incidental todelivery of the goods to their final destination; and 2.9.3 Prices quoted by the tender shall remain fixed during the Tender’s performance of the Framework Agreement. A tender submitted with an adjustable price quotation will be treated as non-responsive and will be rejected, pursuant to paragraph 2.22 unless otherwise agreed by the parties.
