Unit Prices. If unit prices are stated in the Contract Documents or subsequently agreed upon, and if the quantities originally contemplated are so changed in a Change Order that application of the agreed unit prices to the quantities of work proposed will cause substantial inequity to the Owner or the Contractor, the applicable unit prices shall be equitably adjusted as provided in the Special Conditions or as agreed to by the parties and incorporated into the Change Order.
Unit Prices. Unless the Bid Item Schedule contained in Part D specifies otherwise, unit prices for individual line items shall include all costs, including but not limited to, mobilization, maintenance of traffic, insurance, bonds, and overhead and profit.
Unit Prices. To the extent additions to or deletions from the agreement work are subject to unit prices agreed upon in this Agreement, those unit prices shall be applied in determining the equitable adjustment and the Contractor shall not be entitled to any other costs or profit.
Unit Prices. The term “net” as used in reference to “unit prices” means in respect to Change Orders performed in accordance with Case (b) of Article 29 of the General Conditions that the unit prices offered by the Contractor and accepted by the Owner shall be inclusive of all sums for payment, repayment, reimbursement, remittance, remuneration, compensation, profit, cost, overhead, expense, loss, expenditure, allowance, charge, demand, hire, wages, salary, tax, cash, assessment, price, money, bill, statement, dues, recovery, restitution, benefit, recoupment, exaction, or injury. Upon request of the Owner in writing and within such reasonable space of time as the Owner shall designate in writing, the Contractor shall submit for consideration of the Owner proposals in writing for unit prices to be applied in the event Work is authorized by the Owner to be performed under Case (b) of Article 29. Under penalty of false swearing, a principal of the contracting firm shall certify that the unit prices submitted do not exceed current costs for like services or materials.
Unit Prices. Unit prices on the Bid Form shall include the cost and profit of providing all labor, materials, testing, tools and equipment necessary to perform all work in accordance with contract documents. No separate payment shall be made for incidental work relating to Bid Items.
Unit Prices. By application of unit prices to the quantities of the items involved as determined in Section 9.3.
Unit Prices. (1) Except as otherwise provided in the second paragraph of this Section, the unit prices, set forth on the attached Schedule "I" of this Agreement, will be binding upon both the Fund and the Contractor in determining the value of omitted and/or extra work, and, in the case of extra work, such unit prices shall be deemed to include all profit, overhead and expenses of whatsoever kind and nature of the Contractor, its subcontractors and sub- subcontractors, and the Contractor agrees that it shall make no claim for any profit, overhead, expense or percentage override in connection therewith.
(2) Where said Schedule "I" sets forth a unit price for added and/or deducted work, the Fund shall have the option, whenever it is found that the quantity of changed work varies by more than 15 percent from the quantity that is stated or that can be determined by the Contract Documents at the time of execution thereof, to accept or reject such unit price for the quantity that the changed work varies by more than 15 percent from the stated or determinable quantity. Where a quantity is not specifically stated in the Contract Documents, the Fund's determination of the amount of said quantity included in the Contract Documents shall determine the applicability of this paragraph. Where the Fund, pursuant to the foregoing provisions, exercises its aforesaid option, the amount of the increase or decrease in the Contract consideration for the quantity of work which varies by more than 15 percent from the stated or determinable quantity shall be determined in accordance with the provisions of Section 4.02 of the Agreement as if there was no unit price therefor set forth in said Schedule "I”.
Unit Prices. The allowable charge out rate for units or items directly related to the project that are not a part of the normal overhead expense.
Unit Prices. Unit prices, if any, are reflected in the Contractor’s Bid.
Unit Prices. Unit price items and estimated quantities therefor, as provided by the Contractor in the Contract Documents include all costs for furnishing and installing the estimated quantity of each such item as stated, including all indirect costs, overhead, taxes, fees and profit. Subject to the provisions of Paragraph 11.8 of the General Conditions, if the quantity of any such unit price item as actually and properly furnished by the Contractor differs from the estimated quantity for such item as set forth herein, the Contract Sum may be adjusted by Change Order based upon the actual required quantity of such item and the applicable unit price as specified. The unit prices specified shall be applicable to both increases and decreases in the Contract Sum on an equal basis.
