Common use of Terminating Your Membership Clause in Contracts

Terminating Your Membership. (a) You may terminate your membership at any time: if your request for termination is for reason of permanent sickness or physical incapacity and this prevents you from using the Facilities, by notifying us in writing, and including a medical certificate evidencing such permanent sickness or physical incapacity, in which case we will refund any unused Fees on a pro-rata basis; or (b) Subject to the above exception, you may not terminate your membership during any relevant minimum term or receive a refund. This means: (i) you may continue to use the Facilities for the remainder of the relevant Minimum Term (if any); and (ii) if you are paying an Ongoing Fee you must continue to pay the remainder of your minimum term; (iii) if you give us written notice of termination during the Minimum Term, you will cease to have access to the Facilities once this Minimum Term expires. (iv) If your membership does not have an associated Minimum Term, or if you have exceeded this Minimum Term, you may terminate your membership at any time for any other reason, by notifying us in writing with 14 days’ notice. (c) All new memberships are also subject to a cooling off period of 48 hours. (d) A request for termination of membership during the cooling off period must be made in writing unless this Agreement is defined as an unsolicited consumer agreement under the Australian Consumer Law, in which case termination may be written or oral. (e) For any membership terminated validly during the cooling off period, TQ Fitness will refund to you the total of all Fees, excluding an Administration Fee.
